Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation (CORRECTED DURING INSPECTION): Name of the manager was not posted.

Corrective Action(s): Name of the manager must be posted in a prominent place in the facility. Manager was not aware of this requirement and licesning reviewed the legislation with the manager. During the inspection name of the manager was posted by the manager.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Two staff records were reviewed. Manager file had no evidence of a criminal record check.
Corrective Action(s): All staff must have a valid criminal record check in their file before they start employment. Manager cannot work alone with children until criminal record checks results are received.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Licensing reviewed 2 staff records and manager’s certificate had not been validated.

Corrective Action(s): Please ensure that an educator or an assistant holding a certificate issued under Division 2; must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry

Comments

At the inspection dated June 8, 2021 there were four children and two staff present. At this inspection the above noted contraventions were identified. Licensing conducted a walk-through of the entire facility.
The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following were discussed with the manager:

· Posting manager’s name in a prominent and a visible location
· Criminal Record checks for staff
· Validation of staff certificates
· Maintaining staff records
· Placement of outdoor equipment to prevent climbing
· Monitoring pruning of bushes in the outdoor play area
· Selection of healthy and nutritious snacks for children according to Canada Health Food guide

The inspection report was written off-site – details were reviewed with the licensee prior to writing the report. A copy of the routine inspection report and risk assessment sent to manager via email on June 9, 2021.
