Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Upon inspection of the outdoor play area, Licensing observed a rock in a child's mouth posing a chocking hazard.
Corrective Action(s): Please ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Upon inspection, Licensing observed a play structure with a slide located on concrete with no adequate ground surfacing.
Corrective Action(s): Please ensure that adequate ground surfacing is available.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): Upon inspection Licensing observed knives accessible to children in the outdoor play area. The Licensee explained that she is always present with children. These were moved during the inspection and stored in a secured shed with a lock.
Corrective Action(s): Please ensure that children do not have access to any objects or substance that may be hazardous to the health or safety of a child.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: Upon inspection, Licensing observed a person at the facility over the age 12 who was ordinarily present without obtaining a criminal record check. The Licensee explained that a criminal record application has been submitted.
Corrective Action(s): Please ensure that criminal record check is obtained.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Upon inspection, it was found that the fire extinguisher has not been serviced annually. The Licensee explained that she is aware of this.
Corrective Action(s): Please ensure that the fire extinguisher is serviced annually.

CARE AND/OR SUPERVISION: 14060 - CCLR s.39(1) - A licensee must ensure that children are supervised at all times by a person who is an educator, an assistant or a responsible adult.
Observation: Upon arrival to the outdoor area, Licensing observed the Licensee talking on the phone with her back turned to the children. The Licensee was unaware that Licensing was on site.
Corrective Action(s): Please ensure that children are supervised at all times.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Upon review of daily attendance, the arrival times were not recorded for more than one child.
Corrective Action(s): Please ensure daily attendance records are complete and accurate.

RECORDS AND REPORTING: 19210 - CCLR s.58(1)(a) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (a) the diagnoses relevant to the child's requirement for extra support, as made by health care professionals.
Observation: Upon review of child records, there is no care plan available for a child with an allergy. The Licensee explained that she will follow up with the parents.
Corrective Action(s): Please ensure a care plan is available for each child requiring extra support

Comments

At the inspection dated September 12, 2023 there were 7 children 1 staff, and The Manager present. At this inspection the above noted contraventions were identified. Licensee/Manager to provide Licensing with a written response with actions taken to bring facility into compliance. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool will be completed and a copy will be provided.
