Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSOP). All eight care categories were assessed for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: One regular staff member's certificate was not posted at the facility.
Corrective Action(s): Ensure that employee certificates are displayed in a prominent place in the community care facility.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: One staff file did not contain evidence of immunization declaration. .
Corrective Action(s): Ensure staff files are complete.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: Licensing observed that the manager's criminal record check is not current.
Corrective Action(s): Ensure staff records are current at all times.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Licensing observed that the food in the facility's emergency kit was expired. Licensing suggested systems of emergency supply refresh.
Corrective Action(s): Ensure all aspects of the emergency plan are current at all times to ensure that facility can mitigate respond to and recover from any emergency.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: At the time of Licensing's arrival there were 11 children in care with one educator. A second staff member arrived shortly after.
Corrective Action(s): Ensure that the ratio of employees to children attending the CCF is no less than that permitted in schedule E.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Licensing observed 2 children's files did not contain a record showing the date of enrollment.
Corrective Action(s): Ensure children's records are complete.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Upon inspection of the facility attendance records it was noted that only 4 of the 13 children in attendance were signed in with an accurate time of arrival. Intent of accurate record keeping was discussed with the Licensee.
Corrective Action(s): Ensure that for each child there is an accurate record of daily attendance including times of arrival and departure.

Comments

Summary of Inspection:
At the inspection dated June 22, 2022 there were 13 children in care with 2 staff members.
At the inspection, the above noted contraventions were identified.
Please provide Licensing with a written response, by the date noted below, stating how the identified contraventions will be addressed in order to ensure year round compliance.
As part of this Routine Inspection a Facility Risk Assessment Tool was completed.
This report was written off site and is therefore, unsigned. The contraventions and summary items identified in the report were reviewed with the Manager before Licensing's departure.
A copy of the report and the corresponding Risk Assessment was emailed to the Manager.
The following items were discussed:
-The practice of verifying employee references.
-Systems of organization of children and staff records so that most current items are accessible by the manager at all times.
