Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing reviewed 2 staff files and 1 file contained a valid criminal record clearance letter addressed to another agency.
Corrective Action(s): Please ensure that all employees have a valid criminal record check addressed to this facility. .

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Verification evidence of a substitute staff ECEA certificate was not available.
Corrective Action(s): Please ensure that any staff that hold ECE/ECEA certificate issued by the ECE Registry is verified through ECE registry.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Licensing was unable to view record of annual earthquake drill. Staff was unsure whether it was practiced or not.This is a repeat contravention from routine inspection # SMIA-C9B2BS dated 01 December 2021
Corrective Action(s): Please ensure that earthquake drill is practiced and recorded annually.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: One child's file was missing medical insurance plan number.
Corrective Action(s): Please make sure that all children have medical insurance plan number in their file before they start enrolment.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation (CORRECTED DURING INSPECTION): One child's file did not have date of enrolment. Staff corrected this during inspection.This is a repeat contravention from routine inspection # SMIA-BYGTKW dated 22 February 2021
Corrective Action(s): Please ensure children's files are complete.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: There is no emergency contact for one child.
Corrective Action(s): Please make sure that all children have name and contact information of an emergency contact person before they start enrolment.

RECORDS AND REPORTING: 19210 - CCLR s.58(1)(a) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (a) the diagnoses relevant to the child's requirement for extra support, as made by health care professionals.
Observation: No care plan available for a child requiring extra support.This is a repeat contravention from routine inspection # SMIA-BYGTKW dated 22 February 2021
Corrective Action(s): Please make sure all children requiring extra support have a care plan.

Comments

At the inspection dated December 13, 2022 there were eight children and two staff present. At this inspection the above noted contraventions were identified. Licensing conducted a walk-through of the entire facility. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer by December 15, 2022. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following were discussed with the staff:
Care plan must contain clear steps for staff to follow.
Maintaining and updating children records with current information
Use of sleeping equipment used for children must meet manufacturer’s recommendation and Health Canada guidelines

· Fire-Earthquake Drill Log

The inspection report was written on-site and details were reviewed with the Manager prior to writing the report. A copy of the follow up to routine inspection report is provided to the manager at this inspection.
