Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.

Contraventions
Previous Inspection - Contraventions observed on FIR # have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
RECORDS AND REPORTING: 19050 - CCLR s.56(1)(f) - A licensee must keep current records of each of the following: (f) a log of minor accidents, illnesses and unexpected events involving children, that did not require medical attention and were not reportable incidents described in Schedule H.
Observation: No minor incidents have been recorded since the facility opened. Licensing discussed the type of incidents that need to be recorded and the Licensee stated she was not aware of this.
Corrective Action(s): Please make sure all minor incidents and unusual events are recorded.

RECORDS AND REPORTING: 19052 - CCLR s.56.1(2)(b) - A Licensee must keep (b) a current record of each person to whom the written agreement is delivered in accordance with that section [CCALA s.19]
Observation: Files for eight children were reviewed. A parent contract was not available for three files.
Corrective Action(s): Please make sure a parent contract is available in all files.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Files for eight children were reviewed. A care card number was not available for two children.
Corrective Action(s): Please make sure there is a care card number for all children or if the child had medical insurance from another province a proof of that insurance is in the child's file.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Files for eight children were reviewed. The date the child started to attend the facility was missing for three children.
Corrective Action(s): Please make sure the date a child starts at the facility is recorded for all children.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Absences for one child were not recorded on nineteen days for one child in January 2020.
Corrective Action(s): Please make sure that all absences are recorded.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Files for eight children were reviewed. An emergency contact was not available for one child.
Corrective Action(s): Please make sure an emergency contact is available for all children.

RECORDS AND REPORTING: 19120 - CCLR s.57(2)(f) - A licensee must keep, for each child, a record showing the following information: (f) any medication administered to the child, including the amount and the time at which the medication was administered.
Observation: The Licensee administered medication to a child. There is no record of the medication being administered.
Corrective Action(s): Please make sure there is a record of all medications administered to children.

RECORDS AND REPORTING: 19170 - CCLR s.57(2)(j) - A licensee must keep, for each child, a record showing the following information: (j) a record of any person who is not permitted access to the child.
Observation: Files for eight children were reviewed. One file is missing information about a person that is not to have access to a child.
Corrective Action(s): If a person is not allowed to have access to a child this must be recorded in the child's file.

RECORDS AND REPORTING: 19180 - CCLR s.57(2)(k) - A licensee must keep, for each child, a record showing the following information: (k) the date on which the child stops attending the community care facility.
Observation: Files for eight children were reviewed. The date a child stopped attending the facility was not recorded for one child.
Corrective Action(s): Please make sure the date a child stops attending the facility is recorded for all children.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: Files for eight children were reviewed. Two files identify that the children have additional needs and a care plan is not available. The manager was able to describe strategies for one child but was unable to describe what she would do if a child with a medical condition had symptoms of the condition while they were at the facility.
Corrective Action(s): A care plan needs to be available for all children who have additional needs.

Comments

Summary of Inspection
At the inspection dated January 31, 2020 there were six children and one staff present. At this inspection the above noted contraventions were identified. The Licensee is required to submit a written response to Licensing on or before February 7, 2020 stating how the contraventions have been addressed. Licensing will review the response. As part of this routine inspection a facility risk assessment tool is completed and a copy is provided.
The following education was provided:
· If the Licensee is away from the facility they must be replaced by a person with an ECE Certificate. the person must be fully screened before they start work and must have the following in their file: Resume, references (that have been checked), ECE certificate, validation of the ECE certificate, valid criminal record check from the Criminal Record Review Agency, immunization status, first aid.
A Responsible Adult can assist with the children but cannot be left alone with the children.
