Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During the inspection the following was observed in the facility:
-a diaper change mat had a rip in it. This is a repeat contravention from inspection #CLAN-BURQAF
-a crib matress had rips in it.
-one towel was available in the washroom to dry hands. This could cause a potential for cross contamination. Licensing recommended individual towels.
During the inspection the following was observed in the outdoor play area of the facility:
-No lock was observed on the garage shed. The shed contained items that were unsafe. This is a repeat contravention from inspections #CLAN-BBZUZN, #CLAN-BCKV22, #CLAN-BCSNEH, #CLAN-BURQ4F, #CLAN-C9VQEX and #CLAN-CBXSYK.
-a plastic gate was not secured. This lead to other unsafe items in the backyard such as rusty nails on boards in the back corner. This is a repeat contravention from inspection #CLAN-BURQ4F
-Stairs leading to the back porch do not have a gate at the bottom of the stairs to prevent access, This is a repeat contravention from inspections #CLAN-CBXSYK, #CLAN-C9VQEX, #CLAN-BURQ4F, #CLAN-BCSNEH, #CLAN-BCKV22, #CLAN-BBZUZN
-Tricycles were observed in the outdoor play area. A drop off was observed. Please place a barrier to prevent access and provide active supervision at all times when tricycles were used.
-An umbrella stand was behind the shed. This is a repeat contravention from inspection #CLAN-CBXSYK, #CLAN-C9VQEX, #CLAN-BURQ4F, #CLAN-BBZUZN
- A wooden ladder was leaning against the fence. This could cause a potential hazard. This is a repeat contravention from inspection #CLAN-CBXSYK, #CLAN-BURQ4F #CLAN-C9VQEX
-A piece of wood was leaning against the fence. This has sharp edges. This is a repeat contravention from inspection #CLAN-BURQ4F
Corrective Action(s): Please ensure a healthy and safe environment is provided at all times to the children in care.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed several puncture marks in the plastic flooring. This could potentially harbour bacteria. This is a repeat contravention from inspection # #CLAN-CBXSYK, #CLAN-C9VQEX, #CLAN-BURQ4F, #CLAN-C5UMZ9. In addition a doorknob on the sleeproom door was loose. This is a repeat contravention from inspection # CLAN-C5UMZ9.
Corrective Action(s): Please ensure the facility equipment and fixtures are in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed the following during the inspection:
-A bottle of bleach was located under the sink. A lock was applied to the centre cupboard but there was no lock on the right side cupboard. This was easily accessible and at the children's level.This could cause a potentially serious hazard. This was not corrected by the date specified on the routine inspection. This is a repeat contravention from inspections #CLAN-BBZUZN, #CLAN-BCKV22 and #CLAN-BURQ4F and #CLAN-BXSYK
-Plastic bags were located in a cupboard that was accessible to the children. This is a repeat contravention from inspection #CLAN-BBZUZN, #CLAN-BURQ4F, #CLAN-C5UMZ9
-Two botles of bleach and water were located on a low shelf within easy reach of the children.
-Three electrical outlet covers were missing. This is a repeat contravention from inspection #CLAN-BBZUZN, #CLAN-BCKV22, #CLAN-BURQ4F, #CLAN-C5UMZ9, #CLAN-C9VQEX,
-A can of roof sealer was observed on the ground. This is a repeat contravention from inspection #CLANBXSYK and #CLAN-C9VQEX.
-The door to the furnace room was unlocked. Inside was an open bag of ice melter and cans of paint.
-A rusty paint roller was located on the ground. Rust can cause a potential health hazard. This is a repeat contravention from inspection # #CLAN-CBXSYK and #CLAN-C9VQEX
-A rusty shovel. Rust can cause a potential health hazard. This is a repeat contravention from inspection #CLAN-BCKV22,

-Rusty tomato cages in an unlocked shed. Rust can present a potential health hazard. This is a repeat contravention from inspection #CLAN-C9VQEX

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Two staff records were reviewed. One staff record was missing a criminal record check. This staff was the sole person caring for the children.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Two staff records of two were reviewed. The Managers record was missing three references. This is a repeat contravention from inspection #CLAN-CBXSYK

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Two records were reviewed. Both records were missing a verification from the ECE registry. This is a repeat contravention from inspection #CLAN-CBXSYK, #CLAN-BCSNEH, #CLAN-BCKV22

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Licensing observed the fire extinguisher, the first extinguisher was serviced on August 19, 2021. The fire extinguisher was not serviced annually.
Corrective Action(s): Please ensure the fire extinguisher is serviced annually to be prepared in case of an emergency.

POLICIES AND PROCEDURES: 13060 - CCLR s.56(1)(d) - A licensee must keep current records of each of the following: (d) written policies and procedures that are intended to guide employees in the care and supervision of children.
Observation: The centre policies and procedures were reviewed. The active play policy and screen use policy were not observed. This is a repeat contravention from inspection #CLAN-CBXSYK, #CLAN-C9VQEX,

PROGRAM: 18030 - CCLR s.44(1)(c) - A licensee must provide to children a comprehensive and coordinated program of indoor and outdoor activities that (c) complies with the program standards set out in Schedule G.
Observation: Licensing observed the toys, materials and equipment in the indoor and outdoor play area. No toys, materials or equipment were suitable for school age children. In discussion with the staff she stated two school age children attend the program. The staff brings out sidewalk chalk and balls for the children to play with in the outdoor play area. This is a repeat contravention from inspection #CLAN-CBXSYK, #CLAN-C9VQEX, #CLAN-C5UMZ9, #CLAN-BCKV22, #CLAN-BBZUZN

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Three children's records were reviewed. One child was missing a medical practitioner name and phone number. This is a repeat contravention from inspection # CLAN-BURQ4F.

RECORDS AND REPORTING: 19210 - CCLR s.58(1)(a) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (a) the diagnoses relevant to the child's requirement for extra support, as made by health care professionals.
Observation: A care plan was not available for review at the facility for a child requiring extra support. This is a repeat contravention from inspection #CLAN-CBXSYK and #CLAN-C9VQEX
Corrective Action(s): Please ensure a child requiring extra support has a care plan on site.

Comments

At the inspection dated November 9, 2022 there were 4 children, and 1 staff was present. The Manager was not present during the inspection. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by November 23, 2022 unless otherwise specified in the report. Please provide a written response to Licensing by November 23, 2022 stating how you have corrected the above noted contraventions. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was sent to the Manager.

The following education/recommendations were provided:
-The reportable incident reporting procedure.
-The current cleaning protocols that are in place
-Items with a Drug identification number (DIN) were observed in the first aid kit. Please ensure parents/guardians provide written permission prior to applying items with a DIN number.

The inspection findings were not reviewed with the Manager at the inspection as she was not on site. A copy of these documents were sent to the Manager. If you have any questions regarding this report please contact me.
