Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Gardening tools are accessible to children in the back yard.
Corrective Action(s): Please ensure children do not have access to gardening tools.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: During todays a resume was not available for an individual who was providing care.
Corrective Action(s): Please ensure a resume is available for all individuals who provide care.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: During todays inspection care was being provided by an individual who does not have immunization status on record at the facility.
Corrective Action(s): Please ensure immunization status in available for all persons providing care.

STAFFING: 12210 - CCLR s.23(1)(a) - A licensee must ensure that children have at all times immediate access to an employee who (a) holds a valid first aid and CPR certificate, provided on completion of a course that meets the requirements of Schedule C.
Observation: During todays inspection care was being provided by an individual who does not hold a valid first aid certificate.
Corrective Action(s): Please ensure children have immediate access to a person who holds a valid first aid certificate.

STAFFING: 12360 - CCLR s.37(3)(a) - Despite the employee qualifications required by Column 4 of the table in section 1 of Schedule E [group sizes and employee to children ratios], a licensee must replace an absent employee described in Column 1 of the following table who is absent (a) for fewer than 30 consecutive days with a person described in Column 3 opposite that employee and the row in Column 2 labelled as "< 30 days".
Observation: Care was being provided by an individual who is not qualified as a responsible adult.
Corrective Action(s): In the absence of the manager care must be provided by a person qualified as a responsible adult, an Early Childhood Educator or an Early Childhood Assistant.

Comments

Summary of Inspection
At the inspection dated February 2, 2024 there were two children and one individual present. The manager arrived at the facility during this inspection. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the manager, written on site and a copy of this report will be emailed to the manager.
The following were discussed:
Valid CRC are available, reviewed expiry dates.
The following are required for persons providing care to children: resume, two references, immunization status, valid first aid, criminal record check, proof of qualifications.
Section 10 Community Care & Assisted Living Act (operating with only two children for 12 months)
