Report of Findings
On January 7, 2020, Licensing received a concern regarding care and supervision, staffing, and program.

The complainant provided the following details:
-The Licensee intended to transport children in a vehicle with insufficient seat belts
-The Licensee sent a non-staff member to pick up school aged children
-The children play on iPads at the facility

All areas of the complaint were fully investigated. Evidence was obtained from a variety of sources, including interviews and a review of facility records.

Licensing determined the following contraventions:

CCLR Section 19(4)(a) - Early Childhood Educator certificate must be verified
CCLR Section 23(1)(a) - Immediate access to employee with valid first aid

CCLR Section 57(2)(a)(b)(c)(i) - Records for children
Community Care and Assisted Living Act Section 7(1)(b) - Standards to be maintained
Substantiated Contraventions: Evidence for this summary report is based on a combination of the Licensing Officer’s observations, a review of facility records and information provided by the facility staff at the time of the investigation.
Observed Violations/Contraventions: A summary of the violations found during the complaint investigation are listed below.

10070 - CCLR s.11(4)A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: One staff working did not have their Early Childhood Educator certificate displayed.

12040 - CCLR s.19(1)(a)A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Cleared criminal record checks were not available for 2 staff present with the children.

12050 - CCLR s.19(1)(b)A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Reference checks were not available for 2 staff present with the children.

12060 - CCLR s.19(1)(c)A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Resume was not available for 1 staff present with the children.

12090 - CCLR s.19(1)(f)A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not available for 2 staff present with children.

12140 - CCLR s.19(4)(a)A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: One Early Childhood Educator certificate held by a staff was not verified on the Early Childhood Educator (ECE) Registry.

12210 - CCLR s.23(1)(a)A licensee must ensure that children have at all times immediate access to an employee who (a) holds a valid first aid and CPR certificate, provided on completion of a course that meets the requirements of Schedule C.
Observation: One staff present with the children does not hold a valid first aid certificate.

13071 - CCLR s.56(2)A licensee must ensure that the policies and procedures referred to in subsection (1) are implemented by employees.
Observation: Licensee is not following the facility's Screen Time policy.

19080 - CCLR s.57(2)(b)A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: One child did not have date of enrollment documented.

19090 - CCLR s.57(2)(c)A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Daily attendance of children has not been documented since March 1, 2019.

19160 - CCLR s.57(2)(i)A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: One child did not have a photo or digital image on file.

50050 - CCALA s.7(1)(b)(i)A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care.
Observation: Licensee is operating the facility in non-compliance in multiple areas of the Child Care Licensing Regulation (CCLR), which includes the intent to transport children in a vehicle without appropriate car seats and sufficient seat belts.
