Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: The Licensing Officer reviewed four staff files and observed the following:
- 1 staff file did not have a criminal record check and the other staff person does not have a CRC completed through the criminal record review agency in Victoria. This staff person currently has a clear criminal record check from the RCMP on file at the facility. Any staff who do not have a criminal record check or have an expired one, cannot work alone with children until they obtain one.
Corrective Action(s): Please ensure all staff persons have a criminal record check through the criminal records review branch in Victoria

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: 2 out of 4 staff files reviewed were missing verfication of character references.
Corrective Action(s): Ensure that staff records are complete prior to the staff working at the care facility.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Upon review of 4 staff files; 2 staff files did not contain evidence that their ECE certificate was verified by the Early Childhood Educator Registry.This is a repeat contravention from routine inspection # SMIA-C4EQU2 dated 25 June 2021.
Corrective Action(s): The Manager must verify ECE/ECEA certificates through ECE Registry website and keep evidence of this verification in staff’s file. The Manager has done this for other files and has placed a copy of the verification in the staff files. ·Please ensure that all staff records are complete prior to the staff working at the care facility.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Licensing observed there were not sufficient supplies in the emergency bag to recover from an emergency. Some of the food and water were past their expiration date. Licensing provided education that there needs to be sufficient items in the emergency bag for 72 hours for all the children and staff attending the facility. This is a repeat contravention from routine inspection # SMIA-C4EQU2 dated 25 June 2021.

Corrective Action(s): Please ensure that there is an emergency plan in place that sets out procedures to prepare for, mitigate, respond and recover from any emergency for all the children in care.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: Licensing observed that a care plan for one child had not been reviewed within the past 2 years. This is repeat contravention from follow-up to routine inspection # KTOR-BSMTSN 18 August 2020.
Corrective Action(s): Please ensure care plans are reviewed at least once every 12 months with a parent of the child requiring extra support and any person requested by the parent.

Comments

At the inspection dated August 2, 2022 there were fourteen child and four staff present. At this inspection the above noted contraventions were identified. Licensing conducted a walk-through of the entire facility.
The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer by August 5,2022. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following were discussed with the ECE staff:
· Verification of references/certificates for all staff before they start employment
· Checking the emergency supplies to ensure food and water stored is not expired
· Reviewing care plans annually and documenting evidence of this in child's file
· Replenishing First aid supplies in the first aid kits

The following resources were provided and discussed:
· Bulletin-Care Plan
· Staff Immunization Status form
· LO business card

The inspection report was written off-site – details were reviewed with the ECE staff on site and with the Manager over the phone prior to writing the report. A copy of the routine inspection report and risk assessment sent to manager via email on August 3, 2022.
