Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation (CORRECTED DURING INSPECTION): During the inspection of the physical facility it was observed that the managers name was not displayed.
Corrective Action(s): Please ensure the manager's name is desplayed in a prominent area.

LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: During the inspection it was noted that no certificates were posted. Manager stated that she did not know where the certificates might be found.
Corrective Action(s): Please ensure all staff certificates are posted in a prominent area in the facility.
Date to be Corrected: January 22, 2022.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: During the inspection of the physical facility it was noted that a tripod spot light measuring approximately 5 feet in height was placed in front of a cupboard which children were using to access play items, colouring pages, and art items. The tripod spot light presents a tripping hazard to children and staff.
Corrective Action(s): Please ensure children do not have access to any hazardous items.
Date to be Corrected: Immediately

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: During the inspection the manager could not produce the CRC for all three employees. The manager stated that the CRC's for staff might be at the head office.
Corrective Action(s): Please ensure all staff have a criminal record check on file.
Date to be Corrected: January 25, 2022

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: During the inspection the manager could not produce character references for all three present staff. Manager stated that the records might be at the head office.
Corrective Action(s): Please ensure all staff have character references on file.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: During the inspection the manager could not produce a record of a person's work history for all three present staff. Manager stated the records might be at the head office.
Corrective Action(s): Please ensure all staff have a record of their work history on file.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: During the inspection the manager could not produce immunization for all three present staff. Manager stated that she did not know where the information might be found.
Corrective Action(s): Please ensure all staff has a record of immunization on file.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: During the inspection 8 random children's files were inspected and it was noted that all 8 were missing the gender.
Corrective Action(s): Please ensure all children's files are completed.

Comments

At the inspection dated January 11, 2022 there were 11 children, 2 staff and and the manager present. At this inspection the above noted contraventions were identified. Actions required by the licensee and actions required the LO included here. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following education/recommendations were provided:
· Promoting Active Play in the program
· Daily outdoor activities

· Care Plan Bulletin
