Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation (CORRECTED DURING INSPECTION): Licensing observed that the manager's name was not displayed in the facility.
Corrective Action(s): Ensure that the manager's name is displayed in a prominent place in the facility.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing reviewed the staff files, and noted that one staff's criminal record check has expired.
Corrective Action(s): Ensure that the staff's criminal record check is renewed and updated, and included on file.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for two employees.
Corrective Action(s): Ensure that the immunization status for all employees are included on file.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation (CORRECTED DURING INSPECTION): During inspection, Licensing noted that two staff did not have on file their certificate validation.
Corrective Action(s): Ensure that staff certificates are validated, and the validation record should be included on file.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation (CORRECTED DURING INSPECTION): Licensing observed that the annual emergency drills were not recorded.
Corrective Action(s): Ensure that the annual emergency drills are recorded and on file. This item was identified and contravened on Nov. 27, 2019 on routine inspection report #KSEY-BJBPXK.

During inspection, the facility recorded and placed on file the emergency drills that were previously completed.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation (CORRECTED DURING INSPECTION): During inspection, licensing observed that one child was not signed in on the attendance sheet.
Corrective Action(s): Ensure that children are signed in on the attendance sheet upon their arrival.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Licensing reviewed the children's files and observed that one child was missing their emergency contacts.

This item was identified and contravened on June 04, 2021 on routine inspection report #MZIN-C3NU9V.
Corrective Action(s): Ensure that the child's emergency contacts are included on file.

Comments

At the inspection dated May 09, 2022 there were 7 children and 2 staff present.The manager was on-site and assisted with the inspection. At this inspection, the above noted contraventions were identified. Actions required by the licensee includes a written response. The contraventions noted in this report were reviewed with the facility during the inspection.

As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following education/recommendations/discussions were provided:
- Continue to document minor incidents using the incident log bound book, and take note of any illness and unexpected events involving children not requiring medical attention, and that are not reportable incidents as described in Schedule H and staff to initial and date after each documentation
- Accessibility of facility policies
- Care plans and procedures
- Staff immunization and filing
- Continue to clean and sanitize the facility including toys and equipment
- Continue to check the expiry date of items in the emergency supplies kit
- Validation process and filing
