Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Contraventions

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: During the inspection the following was observed in the facility:

-Several paint chips were noted on the classroom walls.
-A telephone jack was taped to the wall

The supervisor stated the telephone jack was broken and needed to be fixed.
Corrective Action(s): Please ensure the facility is in good repair while children are in attendance.

MEDICATION: 16030 - CCLR s.53(2)(a) - A licensee must ensure that a child's medication is not accessible to any child, except that a child may have access to his or her own medication if (a) the child's parent has instructed the licensee to permit this.
Observation: When inspecting the first aid kit a bottle of tylenol was found inside. In discussion with the staff they stated that children are given tyenol when they have a fever. This was corrected during the inspection.
Corrective Action(s): Please ensure that children do not have access to any medication and that medication is stored in a place that ensures the health and safety of children in care

RECORDS AND REPORTING: 19030 - CCLR s.55(2)(a) - A licensee must notify the medical health officer within 24 hours after (a) a child is involved in, or may have been involved in, a reportable incident described in Schedule H while under the care or supervision of the licensee.
Observation: Licensing observed the minor incident log. An incendent that is reportable as described under Schedule H of the CCLR was logged in the minor incident log and was not reported to Licensing. The supervisor stated she was unaware that this incident was a reportable incident. We discussion the differences between a minor incident and a reportable incident and the reportable incident forms were reviewed.
Corrective Action(s): Please ensure reportable incidents are reported within a 24 hour period. Please submit the Reportable incident to Licensing.

Comments

At the inspection dated March 14, 2019 there were 14 children and 3 staff present. At this inspection the above noted contraventions were identified. Please provide a written response to Licensing by April 5, 2019 outlining how you will address the above noted contraventions. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following education/recommendations were provided:

· Promoting Active Play in the program
· Active Supervision
· Lead in the Water
· Posting care plans in the main area of the classroom


The following resources were provided:

· Reportable incident forms
· Outdoor play area (away)

The outdoor play area was observed while the children were in the facility. Some items on site such as litter and cigarette butts, were not safe for the health and safety of children in care. The staff Supervisor stated that the program completes a thorough playground inspection before they use the play area, and removes and disposes of these items prior to the children using the space. In addition the staff positions themselves in a way that provides active supervision. The Supervisor stated they provide materials for free play for the children to use. Another off-site outdoor play area is used 2-3 times per week. A written plan addressing the use and safety of the space, the route that is taken to the off-site area, and a site plan of the off-site outdoor play area must be submitted to Licensing for review. A resource to assist in the creation of this policy was provided.

The inspection was completed on March 14, 2019. This report was reviewed with the Manager prior to signing on March 22, 2019.
