Introduction

A scheduled follow-up inspection to the Routine Inspection #AFUN-BQQLVM dated June 18, 2020 was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSOP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: The outdoor play area that was renovated was reviewed for corrections from the previous contraventions. The following items have yet to be corrected.
- the tunnel mound has turf material on top, several areas have been secured and corrected, the back area still has loose sections that need to be secured, this equipment was confirmed to be closed and children are instructed not to use it until it is corrected.
- the bike path which has eroded areas has been partially corrected, some areas have yet to be corrected, this area was confirmed to be closed and children are instructed not to use it until it is corrected.
- the tunnel slide has been re-secured and reinstalled, the equipment though has some hazards related to the installation of the slide which includes; sharp flashing assessable to children, straps used to secure the slide to the frame pose a pinching hazard to the children playing in the area, frame securing the slide is loose posing a potential hazard to the children using the slide, the resilient surfacing under the slide is not suitable to protect the children from injury using the equipment. This equipment was also confirmed to be closed and children are instructed no to use it until it is corrected and photographs of the equipment were taken at the inspection.
The LO reviewed these items in depth with the facility administrator at the time of the inspection.
Corrective Action(s): Ensure outdoor play materials and equipment accessible to children are safely constructed, free from hazards and in good repair.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Four staff files were reviewed and two new staff did not have confirmation of reference checks being completed. LO reviewed with the facility administrator the intent for ensuring references for staff are checked and confirmed prior to the staff working with the children.
Corrective Action(s): Ensure staff files are complete including confirmation of reference checks being completed.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Four children's files were reviewed and one child did not have a record of a medical practitioner contact name or phone number available.
Corrective Action(s): Ensure children's files are complete including name and phone number of a medical practitioner.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: A child in care on the day of the inspection had a care plan in place that had not been reviewed or updated in over 18 months. LO review with the facility administrator the requirement for updating care plan information.
Corrective Action(s): Ensure children's files are complete including ensuring that a care plan is reviewed and updated at least every 12 months.

Comments

On the inspection date of September 29, 2020 there were 11 children and 5 staff present. At this inspection the contraventions identified during the routine inspection were reviewed for correction and items not reviewed at the routine inspection were inspected for compliance. At this inspection the above noted contraventions were identified. Actions required by the licensee include a corrective action plan required to be submitted and actions required the LO include to review and monitor corrective action plan. This inspection report was completed off site and emailed to the facility the following day.
Additionally a COVID-19 Infection Control Assessment was completed and a copy shared with the facility at the time of the inspection.
