Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10010 - CCLR s.10(1) - Applicants for licences and licensees must notify a medical health officer immediately of any change in the information provided under section 9.
Observation: New manager was appointed and licensing was not informed.
Corrective Action(s): Ensure to inform licensing of any change in the information i.e Change of manager
Date to be Corrected: Immediately

LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: New manager name has not been posted in a prominent place in the facility.
Corrective Action(s): Ensure that the manager's name is posted in the facility

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Upon reviewing 4 staff files a minimum of two character references was not obtained for two employees.
Corrective Action(s): Ensure that references are obtained before the employment starts and are included in the staff file.

STAFFING: 12151 - CCLR s.19(5)(a) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (a) a criminal record check for the person.
Observation: Three volunteer files reviewed and one of them did not have a CRC results in the file.
Corrective Action(s): Ensure volunteers have complete files with all the required documents before they start working in the facility.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Fire Extinguisher has not been serviced annually
Corrective Action(s): Ensure that there is a system in place where the service of fire extinguishers is done before the next due date.

Comments

Summary of Inspection:
At the inspection dated September 28, 2022 licensing met with the licensee and the new manager. Licensing was informed that the past manager has been replaced. At this inspection the above noted contraventions were identified. Licensee is required to submit a corrective action plan to address the contraventions.

The following was discussed:
Informing licensing when there is any change at the facility i.e change of manager.
Ensuring there is a system in place to log the fire drills in one place for licensing to review.
Child Care Licensing Regulation was discussed with the new manager.

The contents of this inspection report was reviewed with the manager prior to the inspection report being written off-site, therefore no signature attached.
A copy of the report was provided to the facility by email. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection, and a 3 year ‘historical’ review of the facility’s compliance and operation.
