Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: During the routine inspection it was noted that the manager's name was not on display in a prominent location. The manager's ECE certificate and first aid were posted, however it was not identified who the manager was.
Corrective Action(s): Please ensure the name of manager is on display in a prominent location.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: During the routine inspection, three (3) staff files were reviewed and two (2) staff files were missing the reference letters.
Corrective Action(s): Please ensure all staff files are complete.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: During the inspection three (3) staff files were reviewed and three (3) files were missing evidence of immunization record. Licensee said that they were not aware of the need of having an immunization form to the file. The Employee Immunization Declaration Form was emailed to Licensee.
Corrective Action(s): Please ensure all staff files are complete.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: During the routine inspection three (3) staff files were reviewed and two (2) staff files were missing validation of ECE certificates. Licensee said she they were not aware of ECE certificates needing to be validated. Education was provided and the link to the ECE Registration was emailed.
Corrective Action(s): Please ensure all staff files are complete.

POLICIES AND PROCEDURES: 13060 - CCLR s.56(1)(d) - A licensee must keep current records of each of the following: (d) written policies and procedures that are intended to guide employees in the care and supervision of children.
Observation: During the routine inspection the policies and procedures were reviewed and it was noted that Active Play and Screen Time policies were missing. Education was provided and the DOLSOP document was emailed to licensee.
Corrective Action(s): Please ensure an Active Play and Screen Time policies are created and added to the policies and procedures of the facility.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: During the routine inspection eight (8) children's files were reviewed and one child's file was missing an MSP number. Licensee stated that the family are new comers to Canada and are still waiting for some forms to arrive.
Corrective Action(s): Please ensure all children's files are complete.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: During the routine inspection eight (8) children's files were reviewed and one (1) child's file was missing an enrollment date.
Corrective Action(s): Please ensure all children's files are complete.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: During the routine inspection eight (8) children's files were reviewed and one (1) child's file was missing an emergency contact person. The Licensee stated that the family are new comers to Canada and they do not have anyone to pick up their child.
Corrective Action(s): Please ensure all children's files are complete.

Comments

At the inspection dated July 07, 2022 there were 5 children and 1 staff present. At this inspection the above noted contraventions were identified. Actions required by the licensee and actions required the LO included here. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following education/recommendations were provided:
· Promoting Active Play in the program
· Education regarding the use of the medicated wipes (only with parental permission) in the first aid kit.
· Education regarding Immunization for employees was provided as well as the Employee Immunization Declaration Form was emailed to licensee.
· Policies and procedures revision and addition of medication administration policy if need be
· Active Supervision
· Lead in the Water
