Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All care categories were inspected for compliance.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: The facility uses a staff qualifications/documentation checklist, as staff files are kept off site. At the time of the inspection Licensing reviewed the checklist for the four staff members on site. As per the checklist, one staff did not have evidence that a criminal record check had been completed.
Corrective Action(s): Ensure staff files are complete, and if a checklist is used it is up to date at all times.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: The facility uses a staff qualifications/documentation checklist, as staff files are kept off site. The document does not include a column to confirm that Early Childhood Education certificates are verified through the early childhood registry.
Corrective Action(s): Ensure all staff files are complete.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: There are three children under 36 months registered in the program including one child who is 28 months old which does not meet the group size requirements in Schedule E of the Child Care Licensing Regulations.
Corrective Action(s): Ensure to meet the requirements of Schedule E of the Child Care Licensing Regulations at all times.

Comments

At this inspection dated September 13, 2021 there were 16 children, the Manager, three staff and one support staff present. At this inspection the above noted contraventions were identified. The Licensee is required to take corrective action to bring the facility in to compliance and provide a written response to Licensing by September 20, 2021. As part of this routine inspection a facility risk assessment tool was completed and a copy will be provided.
The following education/recommendations were provided:
-COVID-19 prevention strategies were reviewed and discussed
-Confirmation of facility contact information; email and phone number
-Ensuring that if a staff qualifications checklist is used, it is up to date at all times
-Ensuring that all facility policies and procedures are available for review at all times

The following resources were provided:

-Sample emergency drill document
-Staff qualifications/documentation checklist (emailed)
-Application for temporary placement (emailed)

The inspection findings were reviewed with the Manager at the time of the inspection and with the Licensee by phone following the inspection. The inspection report and facility risk assessment tool were written off site (.5 hours) and a copy of this report and the risk assessment will be emailed to the Licensee.
