Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: During the inspection of the outdoor physical facility the following was noted:
- yard trimmings such as sticks were scattered on the ground and accessible to children.
- big rocks were in the near proximity of the toddler slide.
- no system in place to ensure the depth and adequacy of protective surfacing. There was no resilient surface for the toddler slide.
Corrective Action(s): Please ensure that the facility is in clean and good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: During the inspection of the outside physical facility the following was noted:
- a plastic broken pot with jagged edges was behind the shed and accessible to young children.
- broken cement slabs were scattered around the play are and were accessible to young children.
- three separate piles of petrified animal feces were found near the toddler slide presenting a hazard to young children.
- sharp rocks were scattered around the play area.
Corrective Action(s): Please ensure children do not have access to any hazardous items.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A review of the facility's file showed that all occupants of the facility have expired Criminal Record Checks.
Corrective Action(s): Please ensure that all occupants have a Criminal Record Check done.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: During the inspection of the emergency supplies it was noted that several packages of food (granola bars and cookies) and baby food jars were expired.
Corrective Action(s): Please ensure you have enough resources to mitigate, respond and recover from any emergency.

CARE AND/OR SUPERVISION: 14360 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: During the inspection it was noted that the licensee was not following the plan submitted with the temporary placement application form submitted earlier in the year. The plan stipulates that a secondary staff is available from 10 AM to 1:00 PM. A second staff arrived on premise approximately 10 min after the licensing officer arrived on premise.
Corrective Action(s): Please ensure that the temporary placement proposed plan is followed.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: A review of 6 children's files showed that 3 children did not have an MSP number.
Corrective Action(s): Please ensure all children's files are complete.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: A review of 6 children's files showed that 1 child did not have a start date.
Corrective Action(s): Please ensure all children's files are complete.
Date to be Corrected: September 24, 2021

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: A review of 6 children's files showed that one child did not have a doctor name and phone number.
Corrective Action(s): Please ensure all children's files are complete.

Comments

At the inspection dated September 8, 2021 there were 6 children and 1 staff present. Another staff arrived after licensing officer was on premise for approximately 10 min. At this inspection the above noted contraventions were identified. Actions required by the licensee and actions required the LO included here. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

A temporary placement is on file.

The following education/recommendations were provided:
· Updated photos of children
· Temporary Placement review and new application due in October
· Maintaining a safe walking area in the indoor play area
