Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSOP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Four staff files were reviewed. Two staff were working in the program during the inspection and one of the staff works at another location but did not have a copy of her certificate posted in the facility. LO discussed the importance of posting certificates for all qualified staff.
Corrective Action(s): Ensure certificates of educators are posted in a prominent place in the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: A window in the facility has a broken screen that is at the same height of the children in care. This allows the children to have access to the window opening and closing mechanism which could pose a risk of injury. The staff were unaware if a work order had been placed to fix this broken screen.
Corrective Action(s): Ensure furniture, equipment and fixtures are clean and in good repair while children are in attendance.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): The Preschool and School-age program first aid kits were reviewed during the inspection. Both kits house first aid products that contain medicinal ingredients to be used in the event of a minor injury. LO discussed with the staff the requirement of having parental permission to use these products in the event of an injury. The staff removed these items during the inspection.
Corrective Action(s): Ensure children do not have access to any substance that may be hazardous to their health and safety.

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: Four staff files were reviewed and one staff did not have evidence of a valid first aid certificate. This staff does have the option of working alone with children sometimes.
Corrective Action(s): Ensure staff files are complete including first aid certificates.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Four staff files were reviewed and once staff file did not have evidence of the educators certificate being validated through the ECE Registry.
Corrective Action(s): Ensure all staff files are complete including validation of certificates through the ECE Registry.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: The program emergency supplies were reviewed during the inspection. Several items to be used in the event of an emergency were observed to be expired reducing the effectiveness of recovering from an emergency. A year checklist was observed within the emergency kit but had not been updated in a while.
Corrective Action(s): Ensure emergency plans and supplies are effective to recover from an emergency.

Comments

Summary of Inspection
On the inspection date of June 18, 2019 there were 11 children and 2 staff present. The manager was not available for this inspection and the staff were able to support the Licensing Officer's (LO's) inquiries during the inspection. At this inspection the above noted contraventions were identified. Actions required by the licensee include a corrective action plan required to be submitted and actions required the LO include to review and monitor the corrective action plan. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
