Introduction

An unscheduled inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP). All areas of the facility were inspected for compliance.

Observed Violations
STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing reviewed 5 staff files and noted one was missing character references.
Corrective Action(s): Ensure character references are obtained prior to employment.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Licensing reviewed 5 staff files and noted one was missing immunization status.
Corrective Action(s): Ensure immunization status is obtained prior to employment.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Licensing reviewed 5 staff files and noted 3 did not contain a record of certificate verification.
Corrective Action(s): Ensure all educator and educator assistant certificates are verified using a system established and maintained by the early childhood registry.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: Licensing noted medication was available for one child, however there were no written instructions or care plan available.
Corrective Action(s): Ensure current care plans are kept and developed in consultation with a parent of the child requiring extra support, and any person requested by the parent.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: Staff said a child who requires a care plan has one developed, however it was not available for review.
Corrective Action(s): Ensure all records referred to in sections 56-58 are kept in a single place at the community care facility.

Comments

At this inspection, there were 17 children and 6 staff present. At this inspection, the above noted contraventions were identified.
The following was discussed with the Staff and Manager:
· Children and staff records
· Minor incident logs

The Manager is to correct the contraventions by the dates indicated, and provide a written response to licensing.

As part of the routine inspection, a Facility Risk Assessment Tool was completed.

The inspection report was written off-site due to COVID-19 protocol – all details were reviewed with the Manager prior to writing the report. A copy of the inspection report and risk assessment will be e-mailed to the Manager.
