Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

Child Records and reporting

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Previous Inspection -
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: On review of the posted Licence, Licensing observed that a current community care facilities licence was not posted. An amended was made to the licence in April 2018. The Manager name is also not posted for parent review.
Corrective Action(s): Please ensure you meet legislative requirements.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: On review of 2 staff files, licenisng observed that 1 staff only had 1 character reference on file and the Manager only had 2 references where 3 are required for a Manager.
Corrective Action(s): Please ensure that the requirements of legislation are met prior to employment

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: On review of 2 staff files, Licensing observed that the manager was missing a resume
Corrective Action(s): Please ensure staff are appropriately screened priot to employment and files are complete.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: On review of 2 staff files, Licensing observed that both were missing verification of ECE certificates through the ECE Registry.
Corrective Action(s): Please ensure all staff certificates are verified using the ECE Registry online system and provide evidence of compliance

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Licensing observed in discussion with the Manager that the annual evacuation drill was practiced but there is no record of it.
Corrective Action(s): Please ensure all records are current and there is a good system in place to ensure compliance. Licensing will provide a copy of the fire drill record as a resource which also contains evacuation drills

CARE AND/OR SUPERVISION: 14090 - CCLR s.40(2) - A licensee providing a care program described as Preschool (30 Months to School Age) must not provide care for more than 4 hours each day to each child.
Observation: Licensing observed that the preschool was oeprating for 5 hours at today's inspection. Manager was unaware that the previous exemption to the maximum hours of care had expired in June 2018
Corrective Action(s): Please ensure the facility does not operate more than legislation allows without an exemption approval.

RECORDS AND REPORTING: 19052 - CCLR s.56.1(2)(b) - A Licensee must keep (b) a current record of each person to whom the written agreement is delivered in accordance with that section [CCALA s.19]
Observation: On review of 7 children's files, Licensing observed that 3 were missing parent agreements to the prepayment information.
Corrective Action(s): Please ensure all records are kept as per section 56.1(2)(b)

RECORDS AND REPORTING: 19220 - CCLR s.58(1)(b) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (b) the courses of action recommended by health care professionals to address the needs of the child requiring extra support.
Observation: Licensing observed a child requiring medication did not have a care plan on site. Manager stated this child is new and she is trying to obtain that information.
Corrective Action(s): Please ensure all information is current prior to the child starting the program. This information is imperative for the staff to know how to respond if the child presents with an emergency situation.

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above

On site today was the manager and a 2nd ECE staff with 9 children.

Discussions with the Manager:-
- Licensing reviewed the evacuation procedure with the Manager
- Licensing provided information regarding Appetite to Play (see above website)
- Licensing recommends ensuring a teacher signature is added to entries in the minor incident log book.
- Discussion on active supervision and following facility policies
- Discussion Re: Reportable Incident reporting to Duty line: #604 587 3936 for emergencies if area Licensing Officer can’t be contacted.
- Bill 5 awareness – Facility has been receiving Licensing Officer’s emails.

Licensing observed Staff engaged with children during outdoor play and free play and circle time

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
A follow up inspection may be conducted due to the number and nature of the contraventions.
