Introduction

An unscheduled inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11120 - CCLR s.15(2)(c) - A licensee must ensure that each piece of furniture or equipment for sleeping (c) is appropriate for the size, age and development of the children intended to use it.
Observation: A child was sleeping in a stroller for their nap.
Corrective Action(s): Please ensure children are sleeping on furniture that is appropriate and meant for sleeping on.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: One staff file did not have a criminal record check on file.
Corrective Action(s): Please ensure to have a facility specific criminal record check on file for each staff. A sharing form has been submitted however a result has not been recieved.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: 2 staff files did not have 2 references on file.
Corrective Action(s): Please ensure each staff file has 2 references on file.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: 2 staff files were missing immunization status
Corrective Action(s): Please ensure each staff file has immunization status on file.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: One staff file was missing verification of their certificate
Corrective Action(s): Please ensure each staff file has evidence of certificate verification on file

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: There was one care plan that is overdue from being reviewed.
Corrective Action(s): Please ensure care plans are reviewed annually.

Comments

At the inspection dated January 16, 2019 there were 9 children and 3 staff present in the Infant room, 9 children and 3 staff present in the toddler room, and 18 children and 4 staff present in the group daycare room. There were also 3 students present on site. At this inspection the above noted contraventions were identified. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following education/recommendations were provided:
 Promoting Active Play in the program
 Temporary Placements
 Active Supervision
 Lead in the Water
