Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation (CORRECTED DURING INSPECTION): During the inspection, it was observed that the cupboard under the kitchen sink, containing bleach for the facility, was not locked. Other drawers containing materials that could be a hazard for children were also left unlocked in the kitchen area.
Corrective Action(s): Ensure a safe environment is provided at all times for children

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: It was observed that there are several places on the walls and corners of the wall where materials have come away from the wall. the gyprock is exposed in several places and is at child level.
Corrective Action(s): Ensure the walls are in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11220 - CCLR s.23(2) - A licensee must have first aid kits that are readily accessible to all employees, including while care is provided off the community care facility premises.
Observation: It was observed that one staff had a group of children on a walk and had taken the only first aid kit in the facility leaving the remaining staff and children without a first aid kit.
Corrective Action(s): Ensure all employees have access to a first aid kit.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: 2 staff files were reviewed and it was found that one staff file did not have evidence of immunization on file
Corrective Action(s): Ensure all staff files are complete

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: A review of 2 staff files revealed that both staff were missing ECE registry validation
Corrective Action(s): Ensure all staff with ECE certification have an ECE registry validation on file

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: Through a discussion with the manager, it was discovered that emergency plans are practiced once per year but not recorded
Corrective Action(s): Ensure emergency plan practice is recorded yearly

STAFFING: 12210 - CCLR s.23(1)(a) - A licensee must ensure that children have at all times immediate access to an employee who (a) holds a valid first aid and CPR certificate, provided on completion of a course that meets the requirements of Schedule C.
Observation: It was observed that one staff does not have a valid first aid and CPR certificate
Corrective Action(s): A plan must be provided to CCFL to ensure that children have at all times immediate access to an employee who holds a valid first aid and CPR certificate.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: 1. It was observed that there is not enough food or drink provided in the emergency preparedness kit to respond to and recover from any emergency. The food provided had expired in 2015.
2. it was observed that the fire extinguisher had not been serviced since 2017
Corrective Action(s): Ensure there is a plan to respond to and recover from any emergency

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Attendance records were reviewed for the year and in the months of November, December and January, there were 10 times where children were missing the sign out times.
Corrective Action(s): Ensure daily attendance records are complete for each child each day.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: During a review of 4 of the children's files, it was found that 2 out of the 4 files did not have the name of a medical practitioner indicated.
Corrective Action(s): Ensure all children's files are complete

Comments

At the inspection dated February 1, 2019, there were 4 children and 1 staff present in the program and 2 children and 1 staff reported on a walk. At this inspection the above noted contraventions were identified . As part of this routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.


The following education/recommendations were provided:

· Active Supervision
· Lead in the Water
