Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance. Licensing was informed that the facility has not used portable #16-98 since last August. Licensing was also informed that the preschool program is not in operation anymore.

Observed Violations
STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: 1 staff file did not contain any evidence of training.
Corrective Action(s): Ensure that copies of certificates and evidence of training and skills are obtained.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: 1 person ordinarily present did not have a criminal record check on file.
Corrective Action(s): Ensure that each person ordinarily present has a criminal record check on file.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: No fire drills were completed in January or February 2020.
Corrective Action(s): Ensure that a fire drill is practiced monthly.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: a person who does not have training for a responsible adult was working as the second staff in ratio.
Corrective Action(s): Ensure that staff to child ratios are no less staff than permitted in Schedule E

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: 1 of 6 children's files did not contain the name and telephone number of a medical practitioner.
Corrective Action(s): Ensure that each child has a record of the name and telephone number of a medical practitioner.

RECORDS AND REPORTING: 19220 - CCLR s.58(1)(b) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (b) the courses of action recommended by health care professionals to address the needs of the child requiring extra support.
Observation: 1 care plan was observed that did not have the course of action recommended to address the needs of the child.
Corrective Action(s): Ensure the course of action to address the child's needs is on the care plan.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: Staff files for multiple staff who worked at the facility this week were not available for review. There is a staff checklist that was last updated in October 2017 that does not have all staff written on it.
Corrective Action(s): Ensure that all staff files are kept in a single location at the facility.

Comments

Summary of Inspection
At the inspection dated March 5, 2020 there were 15 children,2 staff, and 1 volunteer present. At this inspection the above noted contraventions were identified. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer (business card provided). The Licensing Officer will review the response.
As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following education/recommendations were provided:
· Promoting Active Play in the program
· Active Supervision
· Lead in the Water
