Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Contraventions
Previous Inspection - Contraventions observed on FIR # have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation: The hot water temperature was measured at the bathroom sink. It was at 60 C.
Corrective Action(s): Please turn down the hot water temperature and ensure that it does not exceed 49C at all time.
Date to be Corrected: March 15, 2018. The manager adjusted the water temperature during the inspection. Please check it later to ensure it does not exceed 49C.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: 3 staffs files were reviewed. All 3 staff did no have their immunization status in file.
Corrective Action(s): Please ensure that you have obtained their immunization status and kept them in their files.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: 3 staffs' files were reviewed. A staff's CRC and references were missing from file. The manager stated that they have them but could provided during the inspection.
Corrective Action(s): Please ensure you have these documents available upon request.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: 3 children's files were reviewed. one child was missing their immunization status in file.
Corrective Action(s): Please ensure you have obatined all the children's immunization status.

RECORDS AND REPORTING: 19190 - CCLR s.57(3)(a) - A licensee must have in writing from a parent, and maintain at the community care facility, consent (a) to call a medical practitioner or ambulance in case of accident or illness if the parent cannot immediately be reached.
Observation: 3 children's files were reviewed. one child's emergency consent was missing from file.
Corrective Action(s): Please ensure you have obtained all children's emergency consents from parents.

Comments

The manager explained that the fence at the back of the yard was removed about 4 days ago. The retaining wall was damaged last year and was repaired recently. The fence will be installed soon. Children are not playing at the back yard but at a park until the fence is installed.

The fire extinguisher has not come with a service tag. The manager stated that they have a receipt which will indicate the purchase date. Please ensure that all fire extinguishers are serviced according to the manufacturer's instruction.

Please provide a written respond by April 15, 2018 on how the above contravention items have been addressed.
