Introduction

Community Care Facilities Licensing (CCFL) inspected all care categories during an unscheduled routine inspection to assess compliance w/:
• the Community Care & Assisted Living Act
• the Child Care Licensing Regulation
• relevant Director of Licensing Standards of Practices

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Repeat violation from FIR #CGEE-C6734U (23/Aug/2021).
CCFL reviewed all posted certificates: 2 employees' certificate were not posted.
Corrective Action(s): ECE/ECEA certificates must be posted.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Repeat violation from FIR #CGEE:
- BPLM2B (13/May/2020)
- C6734U (23/Aug/2021)
- CFLQPV (21/Jun/2022)
CCFL reviewed all employee documentation: 2 employees' CRCs were addressed to another organization. 2 employees lacked a CRC.
Corrective Action(s): These employees cannot assist w/ toileting/diapering until they obtain a CRC share or a new CRC.

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: CCFL reviewed all employee documentation: 1 employee lacked her ECEA certificate.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Repeat violation from FIR #CGEE-C6734U (23/Aug/2021).
CCFL reviewed all employee documentation: 2 employees lacked their immunization status.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Repeat violation from FIR #CGEE-BPLM2B (13/May/2020).
CCFL reviewed all employee documentation: 2 employees' certificates have not been verified.
Corrective Action(s): Certificates must be verified (https://earlychildhoodeducator.gov.bc.ca/Public/CertAndRenewal/Certificate_Validation.aspx) upon hire & every renewal.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: Repeat violation from FIR #CGEE-BPLM2B (13/May/2020).
The May/2023 fire drill was missed.
Corrective Action(s): Fire drills must be practiced monthly.

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: The last emergency drill was practiced in Feb/2022.
Corrective Action(s): The emergency drill must be practiced annually.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: All fire extinguishers required servicing by 17/May/2023.
Corrective Action(s): All fire extinguishers require servicing.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation (CORRECTED DURING INSPECTION): Repeat violation from FIR #CGEE-CFLQPV (21/Jun/2022).
12 children were combined in the middle room.
Corrective Action(s): Each MACC group may have ≤ 8 children @ any one time, in which ≤ 3 children < 36 months are permitted per group.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Repeat violation from FIR #CGEE-BPLM2B (13/May/2020).
CCFL reviewed all children documentation: 1 child lacked her start date.
Corrective Action(s): All requirements of CCLR s.57 must be obtained by children's 1st day of care.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.

CCFL reviewed all children documentation: 4 children lacked their medical practitioner's name & #, or their walk-in clinic's #.

CCFL reviewed all children documentation: Only 1 child had a photo.
