Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

This report was written at the office. Licensing returned on April 26, 2019 to review and deliver the report.

Contraventions
Previous Inspection -
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: Licensing reviewed 4 staff files and observed that the criminal record check clearance letters for 2 staff were referenced to the previous place of employment. The manager advised that they initiated the sharing process.
Corrective Action(s): Please ensure current records.

POLICIES AND PROCEDURES: 13010 - CCLR s.22(1)(a) - A licensee must have all of the following: (a) emergency exits and a fire drill system approved by a local assistant within the meaning of the Fire Services Act.
Observation: The fire extinguishers in the portables required servicing in January 2019.
Corrective Action(s): Please ensure fire extinguishers are serviced as per the Fire Services Act.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation (CORRECTED DURING INSPECTION): At the time of the inspection an ECE assistant was working as the second staff in the infant program. As per schedule E of the CCLR, an ECE needs to work as second staff in an infant and toddler program.
This contravention was addressed when Licensing returned to review and deliver the report on April 26, 2019.
Corrective Action(s): Please ensure appropriate staff qualifications at all times.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: The attendance record does not reflect times when children are moving between programs in the mornings.
Corrective Action(s): Please ensure an accurate attendance record.

RECORDS AND REPORTING: 19120 - CCLR s.57(2)(f) - A licensee must keep, for each child, a record showing the following information: (f) any medication administered to the child, including the amount and the time at which the medication was administered.
Observation: There was no information on a medical consent form regarding the times when the medication required administration. The information written was, "as needed." Licensing discussed requesting information about symptoms to look for before administering the medication.
Corrective Action(s): Please ensure compliance with section 57 (2)(f) of the CCLR.

Summary of Inspection
At this inspection the above noted contraventions were identified. Licensing provided dates for compliance and is requesting for a written response by May 6, 2019 advising on how the contraventions have been corrected. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following was discussed:
Promoting Active Play in the program;
Ways to keep record of yearly care plan review;
Section 57(2)(g) of the CCLR;
Amalgamation of all programs when applying section 34(4) of the CCLR.
