Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The Community Care Facility License was not posted and the name of the manager was also not posted at the time of the inspection.
Corrective Action(s): Ensure the facility license and name of manager is posted in a prominent place.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: The 3-5 playground has a netting barrier in place throughout. One area has been damaged posing a risk to the children playing in the area.
Excessive sand present on the ramp leading into the playground too posses a slipping hazard to the children too.
Some debris on the Infant/Toddler playground to be removed and several foam safety barriers damaged to be corrected.
The LO reviewed all of these items in-depth with the manager at the time of the inspection.
Corrective Action(s): Ensure a healthy and safe environment is maintained at all times.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Criminal Record Check not obtained for one staff working in the program on the day of the inspection.
Corrective Action(s): Ensure all staff files are complete including Criminal Record Checks.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: A minimum of two character references were not obtained for one employee working at the time of the inspection.
Corrective Action(s): Ensure all staff files are complete including character reference checks.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for two employees working on the day of the inspection.
Corrective Action(s): Ensure all staff files are complete including Immunization status.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: One staff working in the program at the time of the inspection did not have the certificate validated through the ECE Registry.
Corrective Action(s): Ensure all staff files are complete including validating certificates.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Five children's files were reviewed and one child did not have evidence of immunization status.
Corrective Action(s): Ensure all children's registration information is complete including immunization status.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Five children's files were reviewed and one child did not have evidence of a medical practitioner available.
Corrective Action(s): Ensure all children's registration files are complete including Dr's name and contact details.

Comments

On the inspection date of February 20, 2024 there were 40 children and 13 staff present. At this inspection the above noted contraventions were identified. Actions required by the licensee include a corrective action plan required to be submitted and actions required the LO include to review and monitor corrective action plan. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided. This inspection report was reviewed with the manager, completed on site and then emailed to the facility the same day.

Maintenance procedures
Staffing schedule and files reviewed
