Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: The following items were observed during the inspection;
- fridge where children's food is stored not clean or able to assess temperature within the fridge
- surfaces not cleaned then sanitized prior to use in eating areas
- toys and equipment not regularly cleaned or sanitized
- washrooms used by children not cleaned or sanitized
- single use paper towels not accessible in the washrooms where children wash their hands, communal hand towels being used
The LO reviewed all of these items in depth with the Licensee during the inspection.
Corrective Action(s): Ensure furniture, equipment and fixtures are clean and in good repair at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Medication bottles were observed stored in assessable locations within the kitchen eating area. Cleaning products are stored in a cupboard that is not locked and is assessable also within the kitchen eating area. Personal grooming supplies in the washroom was also stored in accessible locations. The LO reviewed the importance of storing hazardous objects or substances in a locked or inaccessible location throughout the house.
Corrective Action(s): Ensure children do not have access to any object or substance that may be hazardous to their health and safety.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11220 - CCLR s.23(2) - A licensee must have first aid kits that are readily accessible to all employees, including while care is provided off the community care facility premises.
Observation: Upon review of the program's outdoor play practices the Licensee shared that a first aid kit was not taken on walks. The LO reviewed the importance of having assess to a first aid kit on and off site and at all times.
Corrective Action(s): Ensure first aid kits are readily accessible on and off site and at all times.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: The program has not conducted or recorded any fire drills. LO reviewed this requirement during the inspection.
Corrective Action(s): Ensure fire drills are conducted and recorded monthly.

POLICIES AND PROCEDURES: 13080 - CCALA s.19 - If a person prepays part of the cost of services provided by a class of community care facilities designated by the Lieutenant Governor in Council, the licensee must, at the time of the prepayment, deliver to the person a written statement setting out the terms and conditions on which a refund of all or any of the prepayment will be made.
Observation: The LO reviewed the program policies during the inspection. While all of the policies are in place none had been shared including the repayment agreement with the parents of the children in care. The LO reviewed the requirement for sharing the program policies with all the families enrolled at the time of registration.
Corrective Action(s): Ensure all policies including repayment are shared with families of children in care.

CARE AND/OR SUPERVISION: 14200 - CCLR s.49(2) - A licensee must not provide care to a child unless the licensee has first ensured that the child's parent or emergency contact can be readily contacted while the child is in care.
Observation: Seven children's files were reviewed. Three children confirmed to be in care in the past few months did not have any registration documents available which includes the emergency contact information. LO reviewed this requirement during the inspection.
Corrective Action(s): Ensure care is not provided unless the Licensee has contacts for the emergency contact for all children in care.

CARE AND/OR SUPERVISION: 14230 - CCLR s.51(1)(b) - A licensee must (b) provide to employees and parents a written statement of the licensee's policy on behavioural guidance.
Observation: The written behavioral guidance policy was not shared with the parents.
Corrective Action(s): Ensure all parents are given the written statement of the policy on behavioral guidance.

HYGIENE AND COMMUNICABLE DISEASE: 15020 - CCLR s.14(4)(b) - A licensee, other than a licensee who provides a care program described as either Preschool (30 Months to School Age) or Group Child Care (School Age), must have in a community care facility a sturdy surface for changing diapers, located outside the food preparation area, next to (b) a wash basin.
Observation: The diaper change table is located in the nap room and not accessible to the washroom sink. LO reviewed this item with the Licensee during the inspection.
Corrective Action(s): Ensure the diaper change surface is located near a sink.

RECORDS AND REPORTING: 19050 - CCLR s.56(1)(f) - A licensee must keep current records of each of the following: (f) a log of minor accidents, illnesses and unexpected events involving children, that did not require medical attention and were not reportable incidents described in Schedule H.
Observation: A log book was not available in the facility. LO reviewed this item with the Licensee.
Corrective Action(s): Ensure a log or minor accidents, illnesses and unexpected events involving children is maintained regularly.

RECORDS AND REPORTING: 19060 - CCLR s.57(1)(a)(b)(c) - A licensee must keep current records for each child showing (a) the information set out in subsection (2), (b) if applicable, the information and agreements set out in subsections (2.1) and (2.2), and (c) the consents referred to in subsection (3).
Observation: Seven children's files were reviewed. All of the children were missing several or all of the required information from their registration forms. The LO reviewed this item in depth with the Licensee during the inspection.
Corrective Action(s): Ensure all children's registration information is complete and available at all times.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Attendance records were observed to be incomplete. The LO reviewed this requirement with the Licensee during the inspection.
Corrective Action(s): Ensure accurate attendance records are maintained at all times.

Comments

On the inspection date of February 22, 2023 there were no children and 1 staff present. At this inspection the above noted contraventions were identified. Actions required by the licensee include a corrective action plan required to be submitted and actions required the LO include to review and monitor corrective action plan and a follow-up inspection to be conducted to ensure complaince. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided. This inspection report was completed off site and delivered to the facility and reviewed with the Licensee the following day.
