Introduction

An unscheduled inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Contraventions
Previous Inspection - Contraventions observed on FIR #EGAU-AUKPXB have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing reviewed 6 staff files and observed that there was no record to confirm character reference verification for a staff member who only provided a list of names and phone numbers.
Corrective Action(s): Please ensure a record demonstrating character reference verification if only a list of names and numbers has been provided.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: Licensing reviewed 6 staff files and observed that the certificate for 1 staff member expired on December 4, 2018 and they continued to work in ratio. Licensing discussed compliance options.
Corrective Action(s): Please ensure valid certificates for staff who work in ratio.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Upon review of records Licensing observed that there was no record to demonstrate that one of the School Age programs practiced the fire drill in November 2018
Corrective Action(s): Please ensure a record is maintained of all fire drill practices.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: The following was identified as non compliance to staff to child ratios:

> An ECE has been working alone in the toddler program in the mornings;
> An ECEA has been working alone in the 30 months to school age program in the mornings;
> An ECEA has been working as second staff in the infant program in the mornings;
> A responsible adult has been covering for IT/ECE staff during breaks when the staff leave the premise.

This is considered a repeat contravention as inappropriate staff to child ratios were identified at the last routine inspection (EGAU-AUKPXB)
Corrective Action(s): Please ensure compliance with staff to child ratios as per schedule E.

RECORDS AND REPORTING: 19120 - CCLR s.57(2)(f) - A licensee must keep, for each child, a record showing the following information: (f) any medication administered to the child, including the amount and the time at which the medication was administered.
Observation: Upon review of records, Licensing observed that information around the time or amount at which the medication was to be administered was missing from multiple medical consent forms. The information written was "as needed."
Corrective Action(s): Please ensure information respecting the time and amount at which medication is to be administered. Please obtain information about symptoms to look for if time is not available.

Comments

Summary of Inspection
At the inspection dated December 10, 2018 there were 7 children and 3 staff in the infant program, 8 children and 3 staff in the toddler program and 13 children and 3 staff in the 30 months to school age program.

At this inspection the above noted contraventions were identified. The manger is to provide a written response advising how the contraventions have been addressed and Licensing will review and monitor the plan.

As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
