Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Five staff files were reviewed. Evidence of references being verified was not available in any file.
Corrective Action(s): Please ensure evidence of references being verified is available for all staff.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for three staff.
Corrective Action(s): Please ensure that immunization status is obtained for all staff.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Files for five staff were reviewed. One ECE Certificate had not been verified through the ECE Registry.
Corrective Action(s): Please ensure all ECE Certificates have been verified though the ECE Registry and proof of verification is available.

RECORDS AND REPORTING: 19051 - CCLR s.56.1(2)(a) - A licensee must keep (a) a copy of the written statement, referred to in section 19 of the Act, that the licensee delivers to persons who prepay part of the cost of services
Observation: Files for 13 children were reviewed. Evidence of the family being given a copy of the parent contract was not available in three files.
Corrective Action(s): Please ensure evidence of families being provided a copy of the parent contract is available in all files.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Files for 13 children were reviewed. A medical insurance plan number was missing in three files.
Corrective Action(s): Please ensure a medical insurance plan number is available in all files.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Attendance records from January 19, 2024 - January 25, 2024 were reviewed. Time in, time out and absences were missing on multiple days for multiple children.
Corrective Action(s): Please ensure daily attendance including time in, time out and absences is recorded.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Files for 13 children were reviewed. Contact information for a doctor or medical clinic was not available in four files and contact information for an emergency contact was not available in two files.
Corrective Action(s): Please ensure all files contain the required information.

Comments

Summary of Inspection
At the inspection dated January 26, 2024 there were 12 children, three staff and the Licensee contact present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the manager and the Licensee contact, written on site and a copy will be emailed to the manager.
The following were discussed:
If a family is not covered by the BC Medical Services Plan, a copy of a private medical insurance plan may be kept in the child's file.
Ensuring all staff are aware of and can implement children's care plans.
Contacting the Licensing Officer if there are questions regarding the operation of the facility.
Ensuring staff are fully screened before they start to work at the facility.
