Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act(CCALA) and the Child Care Licensing Regulations(CCLR) and the relevant Director of Licensing Standards of practice (DOLSOP). All areas were inspected for compliance.

Contraventions
Previous Inspection - Contraventions observed on FIR # have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: Manager's name was posted next the name of a staff person who is not the manager.
Corrective Action(s): Licensee will consider a plan for correction and provide a written response

LICENSING: 10060 - CCLR s.11(3) - When advertising or otherwise offering services to the public, a licensee must identify the care program being offered.
Observation: Sign next to the door, registration forms, and schedules in the program said preschool. Group Child Care (30m-SAC) is the only care type offered.
Corrective Action(s): Please ensure to adjust all documents, and signage to reflect the care type provided.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing reviewed 5 staff files, of those, one file did not contain record of character references had been checked.
Corrective Action(s): Licensee will consider a plan and provide a written response.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Licensing reviewed 5 employee files, of those one employee had no record of the person's work history in the file.
Corrective Action(s): Licensee will consider a plan and provide a written response.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: On Friday afternoons from 4pm-5pm a dance class is offered to children who attend the program. On at least one occasion there were 21 children in the classroom licensed for 16 children, with 1 ECE staff, and two dance teachers.In the second classroom there were 3 children with an ECE staff.
Corrective Action(s): Licensee will consider a plan to ensure compliance, and provide a written response.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: -At least one child was signed into one classroom, however was present in another classroom.

Corrective Action(s): Licensee will consider a plan and provide a written response.

Summary of Inspection:
During today’s inspection 4 staff and 12 children were present.
At this inspection, the above noted contraventions were identified. Licensee is required to submit a corrective action plan to address the contraventions. Licensing will review the written response.
As part of the routine inspection, a facility risk assessment tool was completed, and a copy was provided to the facility along with the report. Copies of the inspection report and the Facility Risk Assessment Tool were reviewed, discussed, and provided to the Licensee/Manager.
