Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Previous Inspection - Not Applicable
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10010 - CCLR s.10(1) - Applicants for licences and licensees must notify a medical health officer immediately of any change in the information provided under section 9.
Observation: Licensing observed some of the children from the Group Child Care 30 months to school age program being cared for in a room that has not been approved by Licensing for available play space. Staff questioned were under the assumption that this room was approved. On review of the facility file, there is no application to use this room as available play space.
Corrective Action(s): Please ensure that only approved space by Licensing is used for care of the children. Please provide an amendment application should you wish to continue using this space.

LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Licensing observed that 2 staff on site today did not have certificates posted in their program rooms.
Corrective Action(s): Please ensure all staff certificates are posted for parental review.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: On review of staff files for those on site at inspection, Licensing observed that 1 staff did not have any character references on file.
Corrective Action(s): Please ensure staff are fully screened prior to employment

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: On review of staff files of those staff on site today, Licensing observed that 1 staff currently working to support a child does not hold any qualifications or have any previous experience to work with children.
Corrective Action(s): This staff must not be employed to have sole supervision of any child.

POLICIES AND PROCEDURES: 13100 - DLSOP Active Play - The Licensee must develop and implement an Active Play Policy to engage children in daily active play, consisting of un-facilitated play and facilitated games and activities.
Observation: On review of facility policies, Licensing could not locate an Active Play policy which is a requirement in relation to the Director of Licensing Standards of Practice for Active Play. Licensing has previously emailed reminders of this requirement over the course of the last 12 months.
Corrective Action(s): Please ensure this policy is created and distributed to parents and available to guide staff.

POLICIES AND PROCEDURES: 13120 - DLSOP Active Play - The Licensee must develop and implement a Screen Use Policy to guide employees in the use of screen time activities.
Observation: On review of facility policies, licensing could not locate a screen time policy which is a requirement of the Director of Licensing Standards of Practice for Active Play. This requirement has been in place for over 12 months and Licensing has emailed reminders of this requirement throughout that time frame.
Corrective Action(s): Please ensure a screen time policy is created and is made available to parents and staff.

RECORDS AND REPORTING: 19220 - CCLR s.58(1)(b) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (b) the courses of action recommended by health care professionals to address the needs of the child requiring extra support.
Observation: On review of children's files, 12 files reviewed, Licensing observed that children requiring additional support did not have a care plan in place which identifies the course of action recommended for staff to effectively assist the children.
Corrective Action(s): Please ensure that any child requiring additional support has a care plan in place to ensure appropriate care is given by staff to address their needs.

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above

On site today was 7 staff and 2 support staff employed by the facility with a total of 27 children within all programs.
Manager was away on a conference today and report will be reviewed with the Manager on a 2nd visit.
Staff to child ratio was in compliance with regulations
Programming is posted and available for parent review and children's work is displayed in the facility.
Licensing observed Staff engaged with children during arrival at the facility and during free play, snack time and outdoor play. Staff used appropriate guidance and language.
Licensing observed the children enjoying their free play and playing cooperatively with each other. Children washed hands prior to snack time.

Discussions with the Staff/Manager:-
- Licensing reviewed the use of available space with the Staff. (See above contravention)
- Licensing also discussed evacuation protocols with staff
- Discussed upcoming certificate renewal with one staff which will expire in December 2017

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.

A follow up inspection may be completed at a later date once contraventions have been addressed.
