Introduction

All care categories were inspected during an unscheduled routine inspection to assess compliance w/:
• the Community Care & Assisted Living Act (CCALA)
• the Child Care Licensing Regulation (CCLR)
• relevant Director of Licensing Standards of Practices (DLSP)

Contraventions
Previous Inspection - Contraventions observed on FIR #CGEE-BNWNUH have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: There were toy trucks & a small plastic picnic table a few feet from the end of the southeast-facing slide.
Corrective Action(s): There must be a 6' safety zone under & around equipment to allow for proper use of equipment, w/ adequate space for entering & exiting.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: The manager's CRC was addressed to another organization. The manager explained that she has a CRC that's addressed to the licensee, but it wasn't onsite.
Corrective Action(s): If unable to locate the manager's CRC that's addressed to the licensee, please apply to share the other CRC w/ the licensee.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: An employee only had 1 character reference in her file.
Corrective Action(s): 3 character references (preferably those who've worked w/ the employee in child care) are required for each employee.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation (CORRECTED DURING INSPECTION): 2 employees' certificates hadn't been validated upon renewal.
Corrective Action(s): Certificates must be validated upon hire & each renewal. This can be done by via:

RECORDS AND REPORTING: 19030 - CCLR s.55(2)(a) - A licensee must notify the medical health officer within 24 hours after (a) a child is involved in, or may have been involved in, a reportable incident described in Schedule H while under the care or supervision of the licensee.
Observation: A review of the minor incident log revealed a reportable incident (RI) from 25/Jun/2021 that was never reported to CCFL.
Corrective Action(s): CCFL gave the manager a copy of "FHA Bulletin from CCFL: Child Care - Incident Reporting in Child Care Facilities." The licensee must ensure that ALL employees review the bulletin & are aware of when & how to report RIs listed under CCLR Schedule H to CCFL.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation (CORRECTED DURING INSPECTION): A child lacked their PHN in their file.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation (CORRECTED DURING INSPECTION): A child lacked a medical practitioner's contact information in their file.

RECORDS AND REPORTING: 19370 - DLSOP Safe Play Space (maintenance of equipment [b3]) - [bullet 3] Keep a log of all inspections, maintenance and repairs.
Observation: The manager explained that outdoor play space (OPS) inspections are conducted 2x/day before children use the OPS, but they're not documented.
Corrective Action(s): Daily, monthly, & annual inspections of the OPS must be conducted & documented. Maintenance & repairs to the OPS must also be documented.

Comments

Summary of FIR #CGEE-C5UM5Y (12/Aug/2021)

8 violations were observed today, in which 3 violations were addressed during the inspection & corrective action for the remaining 5 violation includes:
• ensuring the use zone around outdoor play equipment is unobstructed
• obtaining employee documentation
• ensuring all employees know when & how to report a reportable incident to CCFL
• documenting inspections, maintenance, & repairs re. the outdoor play space

Licensees & employees play a key role in protecting children from, & minimizing the impact of infection & illness. CCFL discussed hand washing, cleaning, & physical distancing as per the BC Centre for Disease Control & the BC Ministry of Health's "COVID-19 Public Health Guidance for Child Care Settings" (http://www.bccdc.ca/Health-Info-Site/Documents/COVID_public_guidance/Guidance_Child_Care.pdf).

The inspection was reviewed w/ the manager; however, this report & the Facility Risk Assessment Tool were written @ the Burnaby Health Protection office & emailed to the manager on 12/Aug/2021.
