Introduction

An unscheduled inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: Licensing noted the name of the Manager was not displayed in the facility.
Corrective Action(s): Ensure the name of the Manager is displayed in a prominent place in the community care facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed the following during the inspection:
- Food debris on the outside of the oven, and in the burners on the stove
- A toilet seat in the upstairs bathroom was broken and in need of repair, and there appeared to be urine on multiple toilet basin rims and on one toilet seat. The toilets were cleaned while licensing was on site.
Corrective Action(s): Ensure the furniture, equipment, and fixtured within it are clean and in good repair.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Criminal Record Check on file is not site specific.
Corrective Action(s): Ensure criminal record checks are obtained for each employee.

RECORDS AND REPORTING: 19030 - CCLR s.55(2)(a) - A licensee must notify the medical health officer within 24 hours after (a) a child is involved in, or may have been involved in, a reportable incident described in Schedule H while under the care or supervision of the licensee.
Observation: The licensing officer was not notified within 24 hours that a child was involved in or may have been involved in a reportable incident as described in Schedule H as required.
Corrective Action(s): Ensure incidences are reported as required.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Licensing reviewed 9 children’s files and noted 1 did not contain their medical insurance plan number.
Corrective Action(s): Ensure a record is kept for each child showing the medical insurance plan number.

RECORDS AND REPORTING: 19190 - CCLR s.57(3)(a) - A licensee must have in writing from a parent, and maintain at the community care facility, consent (a) to call a medical practitioner or ambulance in case of accident or illness if the parent cannot immediately be reached.
Observation: Licensing reviewed 9 children’s files and noted 1 did not contain consent to call a medical practitioner or ambulance.
Corrective Action(s): Ensure consent to call a medical practitioner or ambulance is obtained in writing for each child.

Comments

The following was discussed with the Manager:
· Emergency management
· COVID-19 prevention strategies
· Employee to children ratios

The Manager is to correct the contraventions by the dates indicated, and provide a written response to licensing.

As part of the routine inspection, a Facility Risk Assessment Tool was completed.

The inspection report was written off-site - all details were reviewed prior to writing the report. A copy of the inspection report and risk assessment will be e-mailed to the Manager.
