Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.
At the inspection dated October 28, 2022 there were seven children, one staff and the Manager present. Licensing conducted a walk-through of the entire facility. At this inspection the above noted contraventions were identified. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer by October 31, 2022. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following were discussed with the Manager:
·For clarification Licensee 1 is the operator of this facility. Upon arrival Licensing observed Licensee 2 from another facility was present with the children in the driveway. Three children were standing at the front door with one staff while other children were in the car with Licensee 2. Licensee 2 told Licensing that she was doing a quick drop off of some items for a resident of the house. Licensee 1, Licensee 2 and the Staff are related to each other.
·The upper portion of the house is not for daycare use as part of the facility's floor plan. During a routine walk through of the upper portion of the house, Licensing observed several infant items, including a room set up with a diaper changing area with a playpen. The licensee explained that this room, including all of the infant equipment, is for a family member who recently gave birth. This family member is not a resident of this house. CCLR Schedule E was discussed with Manager.

·Use of sleeping equipment (playpen) used for children must meet manufacturer’s recommendation and guidelines. Health Canada Safe Sleep environment & Safe Sleep Practices Bulletin ( Emailed to the Manager)
Manager asked the routine inspection report and risk assessment to be emailed to her as she was going to the park with the children. The inspection report was written off-site – details were reviewed with the Manager prior to writing the report. A copy of the routine inspection report and risk assessment sent to manager via email on October 28, 2022.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): During inspection two plastic bags were accessible to children in the play area. Licensing expressed concern that a child can easily suffocate if these items are pulled over their head. Manager removed the plastic bags during inspection.
Corrective Action(s): Ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.

RECORDS AND REPORTING: 19050 - CCLR s.56(1)(f) - A licensee must keep current records of each of the following: (f) a log of minor accidents, illnesses and unexpected events involving children, that did not require medical attention and were not reportable incidents described in Schedule H.
Observation: During review of the minor incident log book, Licensing observed that there were no entries since January 2022.Maintaining a regular log of minor accidents was discussed with the manager during routine inspection # SMIA-C79UYG dated 27 Sept 2021
Corrective Action(s): Please ensure all minor incidents including illnesses, injuries and unusual events are recorded, dated and indicated that the parents were made aware at the time of the minor incident.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation (CORRECTED DURING INSPECTION): During inspection review of today's attendance records one child's arrival time was missing. Manager corrected this during inspection.
Corrective Action(s): Please ensure that children's attendance records demonstrate time of arrival and departure.
