Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following;
- The resilient surface under the wooden climber, swing and slide set is not sufficient. There is a thin green tarp on the ground. Potential for a child hurting themselves if coming down the slide, falling off the swing or monkey bars.
Education provided on resilient surfacing.
- There are holes behind 2 of the doors that lead it into play rooms. The holes have exposed white material.
Corrective Action(s): Please ensure that a healthy and safe environment is provided at all times while children are in care.
Date to be Corrected: February 16, 2021.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Upon a review of 1 staff record Licensing observed that the staff is missing a criminal record check. This staff drops off the children and picks them up from school. The Licensee stated that they have completed and submitted forms for a criminal record check.
This is a repeat contravention.
Licensing provided education that all required documents need to be obtained prior to the staff working at the care facility.
Corrective Action(s): Please ensure that staff records are complete prior to the staff working at the care facility.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Upon a review of 1 staff's record, Licensing observed that the staff is missing character references.
This is a reapeat contravention.
Corrective Action(s): Please ensure that staff records are complete prior to the staff working at the care facility.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Upon a review of 1 staff's record Licensing observed that the staff was missing immunization status.
This is a repeat contravention.
Corrective Action(s): Please ensure that staff records are complete prior to the staff working at the care facility.

STAFFING: 12210 - CCLR s.23(1)(a) - A licensee must ensure that children have at all times immediate access to an employee who (a) holds a valid first aid and CPR certificate, provided on completion of a course that meets the requirements of Schedule C.
Observation: Upon a review of 1 staff's record Licensing observed that the staff is missing a valid first aid certificate. The staff is alone with the children during drop offs and pick ups from a school.
Corrective Action(s): Please ensure that children have at all times immediate access to an employee who holds a valid first and CPR certificate.
Date to be Corrected: February 9, 2021.

STAFFING: 12490 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: Licensing observed the following;
- Upon a review of the attendance record for the months of January and February there were 2 days in the month of January that there were 8 children in care. The maximum capacity is 7 for the service type Licensed for. Licensing provided education on the maximum capacity of the facility and that there can be no more then 7 children in care at any given time.
- There were 4 children under 4 years old and of the 4 there was 1 child under 1 years old. According to Schedule E of the Child Care Licensing Regulations if there is a child under 12 months there can only be 3 children under 48 months and of those 3 no more than 1 child younger than 12 months old. The Licensee stated that they did not know this. Education was provided.
Corrective Action(s): The Licensee must operate the community care facility in a manner that will promote the health , safety and dignity of persons in care.
Date to be Corrected: February 9, 2021.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Upon a review of 4 children records Licensing observed 2 children's records missing immunization status. The Licensee stated that the parents have not provided the children's immunization.
Licensing provided education on what would be sufficient to meet the intent of this regulation.
Corrective Action(s): Please ensure that children's records are complete prior to the child attending the care facility.

Comments

Summary of Inspection
At the routine inspection conducted today, February 8, 2021, there were 4 children and the Licensee/Manager present. The Risk Screening - COVID 19 form was completed verbally prior to conducting the inspection. At this inspection the above noted contravention were identified. The Licensee is required to correct all identified non-compliances by the dates indicated above in the violations section. A written response is to be provided to Licensing on the date specified for Licensing to review that appropriate corrective action has been taken to address all identified non-compliances. As part of this Routine Inspection a Facility Risk Assessment Tool is completed.
The following education/recommendations were provided:
Emergency bag supplies.
Emergency cards to be in off site first aid kit
Diaper disposal; suggested having a covered garbage bin.
Soft toys and furniture.
Limiting the toys and rotating them.
cleaning and disinfecting.
Temporary Placement
Requirement of person picking up and dropping off children to school.
Pick up and drop off plan
Wearing masks when there is another adult in the program. Logging all essential visitors.
The contents of the inspection report was reviewed with the Licensee/Manager at the time of the inspection. This report was written off site ( .75 hrs ) due to Covid-19 to help promote health and hygiene. A copy of this report and the risk assessment was emailed to the facility.
