Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.
The following areas were reviewed:

· Nutrition and Food Services

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Contraventions
Previous Inspection -
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: One of the smaller rooms appear to be used as storage room as there was a table dolley with stack of table stored in the corner, with another dolley with stacks of chairs. Manager stated she was unaware the table were stored in the manner, chairs are required for other programs during the weekend.
Corrective Action(s): Please ensure that the equipment is safe and space is available for children.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: One staff person has submitted for CRC, evidence that clearance has been done is unavailable.
Corrective Action(s): Please ensure all employees have a valid CRC

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Person with ECE Certificate validation has not been completed
Corrective Action(s): Please ensure ECE Certificate is validated through the ECE Registry

RECORDS AND REPORTING: 19030 - CCLR s.55(2)(a) - A licensee must notify the medical health officer within 24 hours after (a) a child is involved in, or may have been involved in, a reportable incident described in Schedule H while under the care or supervision of the licensee.
Observation: Review of log book indicates that there were possibly 2 cases, one confirmed where it required to be reported but was not reported to Licensing. Licensing discussed this with the Manager
Corrective Action(s): Please review Schedule H and Section 55(2)(a) of the CCLR to understand what incidents required to be reported.

The violations were discussed with the Manager via phone.
Licensing provided the Incident Reporting April 2019 Bulletin.
Please ensure that the Manager and Licensee contact is made aware of this report.
Please provide a written response to the coded violations by June 10, 2019
