Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed a shelving rack in the Group child care 30 month to school age program space that was not anchored to the wall. This is a safety concern in case of an emergency situation such as an earthquake where the tall shelving rack could tip over - it was full of equipment.
Corrective Action(s): Please ensure a healthy and safe environment is provided at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed a cupboard in the available play space which was unlocked, accessible to children and contained cleaning products which could be hazardous to children. Discussed with the Manager.
Corrective Action(s): Please ensure these products are not accessible to children.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: Licensing observed the attendance record for the Group Child Care school age program (GCC SA) was located in the Group child care 30 months to school age program (GCC 30-SA). In discussion with the Manager, Manager stated that the GCC SA children enter and leave the facility through the main door and walk through the GCC 30-SA program when leaving to go to school and when returning from school. This is considered mixing groups and Licensing has concerns that this would cause disruption for the GCC 30-SA program as a visual and noise distraction. Manager stated that this process has been in place for the 7 years that she has been employed at the facility.
Corrective Action(s): As there is a second entrance to the side of the building, Licensing strongly recommends that this door is utilized as the entrance/exit for the GCC SA program as it does not lead into the GCC 30-SA space at all. Families will also need to be notified of the change to avoid walking through the GCC 30-SA space to collect/drop off their child/ren.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: On review of a random selection of 12 children's files, Licensing observed that 1 child was missing an immunization status and 1 child was missing a care card number.
Corrective Action(s): Please ensure all children's files are accurate at the time of enrolment.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: On review of a random selection of 12 children's files, Licensing observed 2 were missing medical practitioner contact information.
Corrective Action(s): Please ensure all information is complete at time of registration.

RECORDS AND REPORTING: 19200 - CCLR s.57(3)(b) - A licensee must have in writing from a parent, and maintain at the community care facility, consent (b) to release a child to someone other than the parent.
Observation: On review of a random selection of 12 children's files, Licensing observed 2 were missing alternative pick up persons.
Corrective Action(s): Please ensure that children have an alternate pick up person indicated in the registration files to ensure safe release in case of an emergency.

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above

On site today was the Manager with 2 other staff and 13 children. 1 staff left for an appointment.

Staff to child ratio was in compliance with regulations
Programming is posted and available for parent review and children's art work is displayed in the facility
Licensing observed the children just getting ready for outdoor play on Licensing's arrival. this was followed by a circle time and then lunch time.
Staff conduct a safety check of the playground prior to use as it is also used by the public.

Discussions with the Manager:-
- Licensing reviewed the current available play space with the Manager as the Loft space (included available play space) is currently not in use due to renovations. manager stated that it will be back in use within the next few days.
- Licensing provided the immunization poster and discussed requirements of legislation in regards to this subject.
- Licensing recommends informing families of the requirement to use the side entrance for the Group child care school age program to prevent mixing of groups through the main door.
- Active Play Policy and Screen Time policy has been created and reviewed by Licensing - please add to your parent /staff handbook as parents and staff need to be notified.

Licensing observed Staff engaged with children during transitions and lunch time. Staff used respectful and appropriate language to guide the children and meet individual needs.

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
