Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10120 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: During the inspection five children under the age of 3 years old were attending the facility. In discussion with the Manager she stated that one child had come for a drop in day. Licensing and the Manger discussed the children's days of attendance. In examining the attendance schedule it was observed that four children under 3 years old were attending each day (Monday to Friday). Licensing reviewed Schedule E with the Manager outlining that the In-Home multi age care code that is on the license permits a maximum of 3 children under 3 years old at any time. Licensing discussed the option of applying for a temporaray placement.
Corrective Action(s): Please ensure a maximum of 3 children under 3 years old are in attendance at one time to comply with the legislation as outlined in Schedule Eand ensure the health and safety of children in care.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following inside the facility:

-two shelves over 4 feet tall, in the living area were not secured. This could present a falling hazard. Please correct this by Dec 13, 2019
-window limiters were observed on the window sills. The limiters were placed at a distance that may not prevent a child from accidentially falling from the window.
-an electrical outlet was missing a plug cover in the living room. This could present a potential electrocution hazard.
-The lock was not applied to the door leading to the basement. This could present a potential falling hazard. Corrected during the inspection.
Corrective Action(s): Please ensure a healthy and safe environment is provided at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed the following inside the facility:
-two cords were accessible to children. This could present a potential strangulation hazard. This was corrected during the inspection
-the washroom cupboard was unlocked, even though a lock was present on the cupboard. The cupboard contained chemicals such as bleach. This was accessible to children. This could present a potential poisoning hazard.
-bleach and water and another chemical in a spray bottle were located on the counter and the back of the toilet. This was within easy reach of the children. This could cause a potential poisoning hazard.

Licensing observed the following outside the facility in the play area:
-a sharp piece of metal fencing was on the ground within easy reach of the children. This could cause a potential cutting hazard.
-the laundry room door was propped open. The laundry room contained several chemicals that were within reach. This could cause a potential poisoning hazard. This was corrected at the inspection.
-rust was observed on a pipe on the gas meter. This was easily accesssible to children. This could cause a potential health hazard.
Corrective Action(s): Please ensure children do not have access to any objects or substances that are hazardous to their health.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Three out of six staff records were reviewed. One staff record was missing a criminal record check. The Manager showed licensing an electronic file of the criminal record check application for the employee. The health and safety risk to children in care was discussed.
Corrective Action(s): Please ensure a criminal record check is completed and the clearance letter is received prior to an employee commencing work.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Three out of six staff records were reviewed. One staff record was missing a character reference.
Corrective Action(s): Please ensure staff records are complete.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Three out of six staff records were reviewed. One staff record was missing a record of the person's work history.
Corrective Action(s): Please ensure staff records are complete.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Licensing observed that there was no record of an emergency evacuation drill being completed. In discussion with the Manger she stated that the drill was completed in September but it was not recorded.
Corrective Action(s): Please ensure to record the emergency evacuation drill when it is completed
Date to be Corrected: December 13, 2019

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing observed that there was no record of attendance. In discussion with the Manager she stated it was missing. The Manager showed a record of todays attendance only. The risk to the children's health and safety was discussed.
Corrective Action(s): Please ensure to complete a daily attendance record and have it available for review when requested.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Four children's records of eight were reviewed. Two children were missing an emergency contact other than the parents.
Corrective Action(s): Please ensure to provide an emergency contact other than the parents. Licensing recommends the possibility of another parent at the facility.

Comments

At the inspection dated November 29, 2019 there were 5 children and 1 staff and the Manager was present. At this inspection the above noted contraventions were identified. Please provide a written response to licensing by December 13, 2019 addressing how you have corrected the above noted contraventions.. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following education/recommendations were provided:
· Promoting Active Play in the program
· Temporary Placements
· Active Supervision
· Lead in the Water
· Any items with a drug identification number (DIN) or a natural product number (NPN) require a medication authorization form. Some items with a DIN number were removed from the first aid kit
· Using high chairs for eating purposes only was discussed.
