Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DLP). Evidence for this report was based on the licensing Officers observations, review of the facility records and information provided by the facility staff at the time of inspection.
The following areas were reviewed: Licensing, Physical Facility, Staffing, Policies & Procedures, Care & Supervision, Hygiene and Communicable Disease Control, Medication, Nutrition and Food Services, Programming, Records and Reporting
As part of the Routine Inspection a Facility Risk Assessment is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation .environment

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation: Two of the 4 emergeny exits are blocked.
Corrective Action(s): Ensure all emergeny exits are easily accessible in case of emergency.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: The manager of this facility was unable to provide a current Criminal Record Check.
Corrective Action(s): Ensure all employees have a current criminal record check in place.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization information for the manager was not in place.
Corrective Action(s): Ensure each staff has an immunization record in place.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Verifications have not been done for staff or manager.
Corrective Action(s): Ensure verifications have beendone for all staff.

STAFFING: 12210 - CCLR s.23(1)(a) - A licensee must ensure that children have at all times immediate access to an employee who (a) holds a valid first aid and CPR certificate, provided on completion of a course that meets the requirements of Schedule C.
Observation: One staff was on site today (other staff was off site) who has an expired irst aid certificate. This staff confirmed that she needs to take her first aid.
Corrective Action(s): Ensure children have all times immedate access to an employee who holds a valid first aid and CPR certificate.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: The licensee stated that the evacuation site has been changed to a neighbour, however this information is not included in the emergency plan or been shared with families and that staff have not been trained in this emergency plan.
Corrective Action(s): Ensure an emergency plan is in place to prepare for, mitigate, respond to and recover from an emergency and that parents are infomred of this. Staff are required to be trained in this procedure.

POLICIES AND PROCEDURES: 13120 - DLSOP Active Play - The Licensee must develop and implement a Screen Use Policy to guide employees in the use of screen time activities.
Observation: The licensee stated that a screen use policy has not yet been written.
Corrective Action(s): Ensure a screen use policy is developed, implemented and shared with families.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Upon arrival there were 5 children in attendance and only 4 of these children were signed in on the attendance form.
Corrective Action(s): Ensure arrival and departure times are recorded upon arrival and departure.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: The staff who was on site with 6 children did not have access to children's records when asked. She did have parent contact for 5 of the 6 children.
Corrective Action(s): Ensure children's records are in single place.

Comments

During today's inspection, there was one staff on site with 6 children, including 4 children under the age of 3. I had reviewed all of the supporting information for a temporary placement application for an additional child under the age of three and based upon the provisions outlined by the licensee, I approved this because I was of the opinion that there would be no increased risk to the health and safety of children in care. The licensee had stated in this application that two staff would be present on the days when there were 4 children under the age of 3, however on the day of this inspection this was not the case as there was only one staff on site with 6 children, 4 of whom were under 3 and one who does not yet walk. The approval of any temporary placement is subject to on going review and may be cancelled if it is determined that there is an increased risk to children in care. The licensee is also required to notify licensing if any changes to the details of the application are changed and in this case licensing was not notified. At this inspection the licensee stated that she regularly leaves the facility to drop and pick up her own child and the staff leaves Mondays at 3:15 and Tuesdays until 4:00 which is in contradiction to the application to place an additional child under the age of a three. Licensee stated that she will reply to licensing by Tuesday January 9th in the morning to address this.

Health and Safety Plan: CRC for Manager not in place (was applied for February 2017) and 1st aid of Staff expired:
The manager stated that she will be on site at all times to ensure that the children have access to staff with first aid at all times.
Manager stated that she will reply to licensing Tuesday morning with a health and safety plan regarding the lack of a CRC.


The children were seen to play with a wide variety of materials, engage socially, build with blocks, look at books, play with potato Heads. The caregivers were seen to engage with the children and attend to their needs. Immunization poster was provided. Risk assessment will be provided in the near future due to time constraints.
