Introduction

An unscheduled routine inspection was conducted today to assess compliance with the Community Care and Assisted Living Act, Child Care Licensing Regulationand the applicable Director of Licensing Standards of Practice. All areas of the facility were inspected for compliance.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: The Licensee has stored items on top of the disconnected stove, counter tops and top of the microwave. These items are stored in a manner that poses a safety risk to the children as the items could potentially fall onto the children.

Corrective Action(s): This item was previously coded on inspection report #SMOY-B2QNZ5 dated July 16, 2018. The Licensee had satisfactorily addressed this item within the prescribed time line. The Licensee will need to store items in a manner that no longer poses a safety hazard.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11180 - CCLR s.16(4)(a) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (a) suitable for the age and development of the children.
Observation: The Licensing Officer observed children enjoying their lunch. The ages of the children in care ranged from 26 months to 45 months. There was a 26 month and a 45 month old child sitting in high chairs.

Corrective Action(s): High chairs are intended for children up to 18 months of age unless a child has an individualized care plan. The Licensee will stop this practice as it isn't developmentally appropriate for the group of children in care.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11220 - CCLR s.23(2) - A licensee must have first aid kits that are readily accessible to all employees, including while care is provided off the community care facility premises.
Observation: The Licensee has a small first aid kit that contains a few band aids, and wipes. The first aid kit is missing a number of items.

Corrective Action(s): The Licensing Officer provided the Licensee with a list of items to be included in their first aid kits. The items may be purchased individually.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: The Licensing Officer reviewed the facility file prior to attending the facility and noted that for an individual living in the home their criminal record clearance letter has expired. During the inspection the Licensee told the Licensing Officer that they have not renewed the criminal record clearance letter for this individual.

Corrective Action(s): The Licensee must submit an application to the Criminal Records Review Agency to renew this individual's criminal record clearance letter. Until the Licensee has received the updated clearance letter this individual will not have access to the children as they are able to remain on a different level of the house from where care is being provided.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: The Licensing Officer reviewed the children's files and spoke with the Licensee regarding the ages of children in care. On Tuesday's and Wednesday's the Licensee will have 5 children in care under the age of 48 months. The legislation only permits 4 children in care under the age of 48 months. Under family child care the Licensee is only permitted to care for 4 children under the age of 48 months and of these 4 children only 2 children under 24 months. The Licensee

Corrective Action(s): The Licensee will need to adjust her enrollment to meet the legislative requirements.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Upon review of 5 children's records none of the files contained the child's start date.

Corrective Action(s): Ensure all information is obtained by the families prior to children attending the facility.

Comments

At the inspection dated, June 18, 2019 there were 4 children and 2 individuals present. At this inspection the above noted violations were identified. As part of this routine inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The Licensing Officer discussed with the Licensee using children's first names on the sign in and out sheet. The current practice has been to use the child's initial for their first name only. The intent of identifying children on the sign in out sheet is for emergency purposes and personnel therefore the use of a child's name is important for clarity.

This report was reviewed with the Licensee prior to signing.
