Introduction

All care categories were inspected during an unscheduled routine inspection to assess compliance w/:
• the Community Care & Assisted Living Act (CCALA)
• the Child Care Licensing Regulation (CCLR)
• relevant Director of Licensing Standards of Practices (DLSP)

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12470 - CCLR s.60(4) - Immediately after a person who was the subject of a character reference is no longer employed by or ordinarily present at the community care facility, a licensee must return all character references to the person, or destroy the character references.
Observation (CORRECTED DURING INSPECTION): A former employee's references remained in her file.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: *REPEAT VIOLATION FROM FIR #CGEE-AMVPVG (31/MAY/2017) & FIR #CGEE-B8VRM7 (29/JAN/2019)*
The licensee explained that fire drills are practiced monthly & emergency drills are practiced every 3-4 months. The last documented practices were:
• fire drill (Oct/2021)
• emergency drill (Mar/2021)

CARE AND/OR SUPERVISION: 14360 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: *REPEAT VIOLATION FROM FIR #CGEE-C49UZ5 (23/JUN/2021)*
7 children were in care today, which included 5 children 26-46 months. The licensee explained that:
• these 5 children < 48 months attend on Mondays, Wednesdays, & Fridays
• 4 children < 48 months attend on Tuesdays & Thursdays
• she prefers to care for children ≥ 24 months
Corrective Action(s): Family Child Care permits ≤ 4 children < 48 months. FHA & the licensee discussed ways to come into compliance:
• limiting care to 4 children < 48 months @ any 1 time
• applying for a temporary placement (approval subject to FHA's approval)

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.

For the past 3 days, a school-age child has been signed in @ 07:30 but not signed out upon departure.

Summary of FIR #CGEE-CEQLRM (25/May/2022)

FHA observed 5 violations today, in which 3 violations were corrected during the inspection & corrective action for the remaining 2 violation includes:
• document all fire & emergency drill practices
• maintaining the correct maximum group size & ages @ all times

FHA discussed key points from BCCDC's "Public Health Guidance for Child Care Settings" (http://www.bccdc.ca/Health-Info-Site/Documents/COVID_public_guidance/Guidance_Child_Care.pdf).

The inspection was reviewed w/ the licensee; however, this FIR & the facility risk assessment tool were completed @ the Burnaby Health Protection office to the licensee on 25/May/2022.
