Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: During the inspection 4 employee certificates were not posted in the facility.
Corrective Action(s): Please ensure staff certificates are posted in a prominent place.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: During the inspection Licensing observed the protective membrane in the outdoor play area. Several areas were exposed next to the wooden climbing area and the slide. This could present a tripping hazard.
Corrective Action(s): Please ensure the outdoor play area is safely constructed and free from hazards.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed the following:
-Polysporn, bactine and matches in the first aid kit at children's level. Relocated during inspection
-Several bottles of sunblock located at the children's level
-Two bottles of bleach and water located at the edge of the counter at the children's level
-One bottle of vital oxide cleaner with a label that reads, 'keep out of reach of children' at the children's level
-Several fan cords were uncoiled at the children's level
-Rust on the floor underneath the washroom stalls.
Corrective Action(s): Please ensure children do not have access to any objects or substances that may be hazardous to their health and safety

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: Two certificates or other evidence of the person's training and skills were not obtained. One of the certificates was submitted by the employee during the inspection.
Corrective Action(s): Please ensure staff records are complete.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for one employee.
Corrective Action(s): Please ensure children's records are complete.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation (CORRECTED DURING INSPECTION): Licensing reviewed the staff records one verification from the ECE registry was missing.
Corrective Action(s): Please ensure staff records are complete.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: During the inspection Licensing observed that there was no fire drill recorded for the month of May. An evacuation drill was recorded instead
Corrective Action(s): Please ensure to practice a fire drill each month and document this.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: In discussion with the Manager Licensing determined that 14 children were attending the school age program prior to starting kindergarten. This does not meet the criteria for school age as the children must be enrolled and attending school.
Corrective Action(s): Please ensure children are divided into groups according to the care code permitted on the child care facility license.

Comments

At the inspection dated August 30, 2023 there were 12 children (present), 4 staff and the Manager were present. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by September 13, 2023, unless otherwise specified in this report. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was provided to the Manager.

· Lead in the Water
· The maintenance plan for the facility
