Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During inspection Licensing observed:
-In the infant and toddler room the diaper change pad had a tear exposing the foam underneath it which cannot be sanitized.
-In the outdoor play used for 30 months to school age a child was playing with a metal chain attched to the chain link fence.This was corrected during inspection as staff made the chain inacessible to children.
Corrective Action(s): A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11160 - CCLR s.16(3)(a) - A licensee must ensure that the entire outdoor play area is (a) enclosed in a manner that is suitable for the age and development of children, and will ensure that children are free of harm.
Observation: During inspection Licensing observed two separate sections of the outdoor fence were missing wooden slats with a noticeable large gaps showing the neighbour’s backyard and there was a wide opening underneath the chain link fence.
Corrective Action(s): Please ensure that the outdoor play space is fully enclosed to ensure children are free of harm.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: The Licensing Officer reviewed five staff files and observed:
-One staff file had no evidence of a valid criminal record check. Discussed with the manager that this staff cannot be alone with children until valid criminal record check is received.
- One staff's criminal record check had recently expired.
This is a repeat contravention from routine inspection # SMIA-C3MVD8 dated 3 June 2021.
Corrective Action(s): Please ensure that all staff have a current record of a criminal record check located in the community care facility. Please send written confirmation when criminal record checks are received.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: 1 staff's certificate has not been verified through the Early Childhood Educator Registry.
Corrective Action(s): Please ensure that any staff that hold ECE/ECEA certificate issued by the ECE Registry is verified through ECE registry.This is a repeat contravention from routine inspection # SMIA-C3MVD8 dated 3 June 2021.

Comments

Student from Justice Institute of British Columbia (JIBC) was present with the licensing officer for practicum training purposes. At the inspection dated August 8,2022 there were forty four children and seven staff present. Manager arrived later mid-way through the inspection. At this inspection the above noted contraventions were identified. Licensing conducted a walk-through of the entire facility.
The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer by August 11,2022. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following were discussed with the Manager:

· Bottles of solution must be clearly labelled with the contents.
· Practicing annual emergency drill using the contents of the emergency supplies with children and staff
· Use of positive guiding strategies to guide children’s behaviour
· Storage of toys and equipment in a way that does not pose a risk to children in an event of an earthquake
· Storage of diaper cream so it is not accessible to children
· Safe storage of empty buckets to prevent children from climbing into or on it

The inspection report was written off-site – details were reviewed with the Manager prior to writing the report. A copy of the routine inspection report and risk assessment sent to manager via email on August 8,2022.
