Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). .

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: 2 out of 5 staff files reviewed were missing valid criminal record check.
Corrective Action(s): All staff must have a valid criminal record check in their file before they start employment. Manager stated that criminal record have already been applied. Please send written confirmation to licensing when results of criminal record checks are received.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Licensing reviewed 5 staff records and 5 staff's certificate has not been validated.

Corrective Action(s): Please ensure that an educator or an assistant holding a certificate issued under Division 2; must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry.

RECORDS AND REPORTING: 19210 - CCLR s.58(1)(a) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (a) the diagnoses relevant to the child's requirement for extra support, as made by health care professionals.
Observation: Two children with additional needs are missing a care plan.
Corrective Action(s): Please ensure there is a care plan written and in place for each child who requires extra support.

Comments

At the inspection dated June 18, 2021, there were sixteen children and five staff present. At this inspection the above noted contraventions were identified. Licensing conducted a walk-through of the entire facility.
The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following were discussed with the manager:
· Maintaining staff and children records
· Validation of staff certificates

The following resources were provided and discussed
· ECE Registry validation link (via email)
· Sample Emergency Anaphylaxis Form (via email)
· LO business card

The inspection report was written off-site – details were reviewed with the Manager prior to writing the report. A copy of the routine inspection report and risk assessment sent to manager via email on June 18, 2021. Total time includes writing report in office.
