Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance with the exception of (list areas not reviewed at the routine inspection).

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11080 - CCLR s.15(1)(a) - A licensee must supply equipment, furniture and supplies that are (a) of sturdy and safe construction, easy to clean and free from hazards.
Observation: 2 shelving units located in the school-age area appear unstable easily sway side to side and may cause injury should they fall.
Corrective Action(s): please ensure shelving units are secured in a way to prevent risk of potential injury.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): 3 exposed electrical outlets observed in areas accessible to children, cleaning supplies stored in an area within the washroom within reach of school-age children. The licensee covered the outlets and removed the cleaners during the inspection
Corrective Action(s): please ensure children do not have access to any object or substance which may be hazardous to their health or safety.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: 5 staff files audited 2 did not contain CRC clearance , ( 1 process at the RCMP , 1 expired ) as issued through the Criminal Records Review Program.
Corrective Action(s): Ensure current CRC clearance is obtained as required to be process through the Criminal Records Review Program , CRC's are to be renewed every 5 years.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: A review of the fire drills observed 5 months missing OCT - Dec 2018 & Jan - Feb 2019.discussed some solutions which may flag when drills are required to be implemented.
Corrective Action(s): Create a system to ensure monthly fire drills are practiced and recorded for both the preschool and school-age programs in order to prepare both staff and children in evacuation.

PROGRAM: 18060 - CCLR s.44(3)(4)(5) - A licensee, other than a licensee providing a care program described as Occasional Child Care, must provide each child with daily outdoor play periods unless weather conditions would make it unreasonable to do so. (4) Despite subsection (1), a licensee who provides a care program described as Occasional Child Care need not provide a program of outdoor activities. (5) Despite subsection (3), that subsection applies to a licensee who provides a care program described as Child-minding only if the program provides care for 3.5 hours or more each day.
Observation: Facility licensed in 2016 with a play area away plan in place - plan is to utilize a nearby park as put forward by the licensee,it is however noted that this plan is not being followed. Licensee confirmed that Preschool children do not attend outdoor play periods and school-age will on days of school closure ( full days in care )this is found to be an ongoing programming issue / also capture as a contravention in previous inspections. Posted daily routine does not include an outdoor play period and Active Play policy does not include elements of outdoor play. A written response provided by the licensee at a previous inspection states the following:We will provide outdoor play periods daily , weather pending a copy of this was provided to the licensee during today's inspection.
Corrective Action(s): please include in your written response your outdoor play area plan and schedule, this plan is required to be implemented.Further follow - up will occur as this is a repeated contravention.

RECORDS AND REPORTING: 19050 - CCLR s.56(1)(f) - A licensee must keep current records of each of the following: (f) a log of minor accidents, illnesses and unexpected events involving children, that did not require medical attention and were not reportable incidents described in Schedule H.
Observation: A log book for documentation of minor incidents , illnesses , events was produced however did not contain entries, this is noted to be a repeated contravention.
Corrective Action(s): discussed ensuring systems are created that work for the licensee , it is required that any minor incidents , illness and unexpected event be documented.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Attendance records do not consistently reflect absence of children , spaces remain blank.
Corrective Action(s): ensure a system is developed which includes whether children are absent , present in addition to times of arrival and departure.

Comments

Summary of Inspection - At the inspection dated March 5, 2019 there were 10 children and 2 staff present. At this inspection the above noted contraventions were identified. The licensee to provide a written response by March 14, 2019 outlining how both programs ( School-age and Preschool ) will be provided with daily outdoor play opportunities. Licensing to review the written outdoor play action plan and respond. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
