Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.
The following areas were reviewed:
· Licensing
· Physical Facility
· Staffing
· Care & Supervision of the children in the infant and toddler classrooms. Licensing will follow up for children in the group child care 30 m- SA program.
· Hygiene and Communicable Disease Control
· Medication
· Nutrition and Food Services
· Program
· Records and Reporting

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: A metal bracket was observed on the floor in the nap room of unit 4 with the potential to injure a child.
Corrective Action(s): Please address the metal bracket on the floor to create a safe environment.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation (CORRECTED DURING INSPECTION): 1 of 5 staff files reviewed did not contain immunization status.

STAFFING: 12151 - CCLR s.19(5)(a) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (a) a criminal record check for the person.
Observation: 1 volunteer was on site today did not have a criminal record check.
Corrective Action(s): please obtain a criminal record check prior to volunteering.

STAFFING: 12152 - CCLR s.19(5)(b) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (b) character references in respect of the person.
Observation: 1 volunteer that was on site today did not have any references.
Corrective Action(s): Please obtain references for the volunteer.

STAFFING: 12153 - CCLR s.19(5)(c) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (c) evidence that the person has complied with the Province's immunization and tuberculosis control programs. .
Observation: 1 volunteer was on site with no record of immunization.
Corrective Action(s): please obtain evidence of immunization.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: 1 child who already turned 3 was in the program for under 36 months. The group child care 30m-SA was closed today and the Manager agreed to help a family by accepting the child in the infant toddler program. The Manager stated next time she will ask the Licensing Officer for a temporary placement for the day.
Corrective Action(s): please ensure children are divided into groups with no more children than permitted in schedule E.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: A child requiring a care plan does not have a care plan developed with the parent.
Corrective Action(s): Please create a care plan with the diagnosis and the course of action recommended in consultation with the parents.

Comments

Discussed with the manager the following information
· Active supervision and the need to have visual and auditory supervision of the children. The children use a walking rope when walking to the away play space. Staff are situated at the front and back of the group and if a 3rd staff is with the children they walk in the middle. The doors to the outside are locked and an alarm beeps every time a door opens.
· The necessity of flushing the taps prior to use every morning. This can be done by letting the water run at the tap for 5 minutes.
· The Manager is aware that she must contact a Licensing officer within 24 hours after a reportable incident occurred. A discussion about disruption of service being a reportable incident was had with the manager.
· Inspected the emergency supplies for the facility. It was observed that some of the food expired. A conversation with the Manager to create a system to review expiry dates on the food in the emergency supplies, currently the food is reviewed for expiry twice per year. The Manager is deciding if she would buy food for the children or continue to ask families to provide.
· The nap room in unit 4 is currently used to store toys. A discussion was had with the Manager that the nap room must be available for children to use. The Manager stated that she will remove items stored in the nap room.

Licensing reviewed with the Manager an application for exemption to have a responsible adult work in place of an ECEA while the ECE registry is reviewing the application. Through the information in the application and received today it has been approved. The exemption will be in place from Aug. 1, 2018- Sept. 30, 2018 or until the Manager informs Licensing that it is no longer required.
