Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care Assisted Living Act (CCALA) and the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Inspection of the Group (Under 36 month) room was found to have the following:
- Chipped counter top in the sink area that exposes the wood below. This area can no longer be sanitized and requires replacement or repair
- Two wooden chairs that had chips that exposed wood that can produce splinters
- Two tables that have chipped paint
- Padding that covers the corner of the book shelf that is covered in duct tape that requires replacement
- Padding that covers the window sill area at child level that requires repair or replacement
- Chipped walls that require repair
Corrective Action(s): A plan to repair or replace any broken fixtures or equipment

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: During inspection of the washroom diaper change area, the following was found:
- A 5 foot cabinet used to store supplies was not fixed to the wall
- Diaper cream is stored at child level
Corrective Action(s): Cabinet is required to be fixed to the wall or removed
- Diaper cream stored out of reach from children

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation (CORRECTED DURING INSPECTION): A review of 4 staff files found that two files only had one character reference verified.
Corrective Action(s): During inspection, manager was able to verified that these references had been checked and provided documentation during inspection

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation (CORRECTED DURING INSPECTION): A review of four staff files found that four files were missing validation of ECE and ECEA certificates.
Corrective Action(s): Corrected during inspection and a plan was described to review remaining files and update.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Daily attendance records reviewed for Group Child Care (under 36 months) and (30 months - SA) found that children's records did not consistently have time of departure recorded over the past month. A review of the (School Age Care on School Grounds) records found that records were complete regarding absent, present and arrival and departure times.

Comments

At today’s inspection there were 46 children and 14 staff present. Licensing conducted a walk through of the entire facility.
At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer by April 10, 2024. The Licensing Officer will review the response.
As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy was provided to the facility along with this report. The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.
The contents of the inspection report was reviewed on site with the licensee prior to the inspection report being written off-site; therefore, no signature attached. A copy of this report will be emailed to the manager on March 27, 2024.
The Licensing Officer met with the manager and discussed the following:
- Renewal of Staff certificates
- Training provided by local community professionals for staff inservice
- Removal of items kept on and beside the sink in School Age Care and Under 36 room during inspection
- Exemption process discussed
