Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSOP). All care categories were assessed for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: LO observed and discussed the following with the Manager:
Outdoor play space:
-Not sufficient resilient surface, i.e. woodchips. Plastic underneath is showing which poses trip and fall hazard
-Broken lock for the playground gate
Washroom upstairs(boys):
- cleaning liquid was stored under the sink; the cupboard was unlocked and accessible to the children.
Corrective Action(s): Ensure that a healthy and safe environment is provided all times while children are in care

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: 5 staff files were reviewed; 1 staff CRC is not site specific.
Corrective Action(s): Ensure that all staff files are complete.

STAFFING: 12290 - CCLR s.34(4)(b) - Despite this section, during the half hour before a care program begins and the half hour after a care program ends, a licensee may permit children who would otherwise be grouped in different care programs, and who are arriving at or leaving the community care facility, to be grouped together and supervised other than as required under Schedule E if (b) a total of 8 or fewer children are present at the community care facility, of whom no more than 3 are younger than 36 months old.
Observation: LO observed ( audit of records) for today. There were total of 9 children grouped in one single group with more than 3 children younger than 36 months old present for the first 30 minutes of the day.
Corrective Action(s): Ensure that appropriate group size is maintained at all times.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: 10 children files were reviewed; 2 children's start dates were not recorded on their files.
Corrective Action(s): Ensure that all children's files are complete.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: 10 children's files were reviewed; 1 child's Dr information was missing.
Corrective Action(s): Ensure that all children's files are complete.

Comments

On the inspection date of October 26, 2023 there were 41 children and 9 staff present. At this inspection the above noted contravention was identified. Actions required by the licensee include to bring the facility into compliance and submit a written response to Licensing for review. As part of this Routine Inspection a Facility Risk Assessment Tool is completed. The content of this inspection was reviewed with the Manager onsite and the copy was provided.
