Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act(CCALA) and the Child Care Licensing Regulations(CCLR) and the relevant Director of Licensing Standards of practice (DOLSOP).

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed:
-Razor, shaving cream, and cleaning supplies accessible to children in the bathroom. (licensing noted there were no children in care on the day of the inspection).
Corrective Action(s): Please ensure that a healthy and safe environment is provided at all time.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: Three persons over the age of 12 years had no criminal record check obtained for them. Licensee has no children in care until September, therefore these persons would have no access to children while in care until the criminal record checks are complete.
Corrective Action(s): Please ensure not to permit persons over the age of 12 to be ordinarily present on the premises of the community care facility while children are present unless the person is of good character and the licensee has obtained a criminal record check.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: The food and water supplies were observed to be expired, in addition, the annual emergency evacuation plan had not been documented.
Corrective Action(s): please ensure to create an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Licensing reviewed 3 children's records, 3 of the records have not date of enrolment or withdrawal.
Corrective Action(s): Please ensure to show record of date of enrolment and withdrawal.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing observed the attendance was not available for two of the days children were in care, and no record of arrival and departure before July of this year.
Corrective Action(s): Please ensure to keep record showing the daily attendance.

Comments

Summary of Inspection:
During today’s inspection, licensee was not providing care, and there were no children present. Licensing asked if the licensee would want to go ahead with the inspection and the license welcomed licensing to complete the inspection at this time. Licensing will return for a follow up inspection to observe children in care on another date. The above noted contraventions were identified. Licensee is required to submit a corrective action plan to address the contraventions.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy was provided to the facility along with this report.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

The following education/recommendations were provided:
· Licensing confirmed expiry dates for valid criminal record checks
· Licensing observed several areas of dog feces on the grass outside, however the facility was not providing care for children during the date of the inspection. The licensee said they clean the dog feces every morning as part of the outdoor check, before children arrive. The licensee explained that the plan is to create a fenced in gravel area for the dogs to use, where children will not have access within the outdoor area. Licensee will provide photos of changes to the back yard area.
